Hi Guys;

Congratulation to everyone with on-coming interview dates and those that have been approved.

I have a questions...hopefully I can get clarification. So I needed a waiver, (Form 1-601) and if anyone is familiar with this, I am not sure whether this is needed for the NVC process or the embassy. I filled the form and paid for it with my reasons but my lawyer didn't file it, saying that, if they need it that is when he will file it.

Now, my case is complete with NVC and I have an interview date, do you guys think I still need to file the waiver? Sometimes these lawyers are so off, so I always want to cover all bases just incase...

Please let me know if anyone has ever been asked to complete the waiver and where exactly it will be needed.

February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I filed the waiver 601 before my attorney sent the package to NVC,it took me 3 months to got approved. Its important you have your waiver filed and approved before interview, otherwise they will ask you at the interview to apply for it and you guys have to wait overseas till its got approved.

Wow, I wish I had follow my first instincts. Oh dear God I would hate for it to be something we are asked at the interview. Let me get on it immediately

Interview date April 28th.

Overstaying F-1 Visa (ooooppssy daisy) but does it really matter thou? The reason? I mean I came home and started the filing process as they ask?

I think, on the form it states all the reasons and mine is one there as well so I believe I need it so does my lawyer as he asked me to complete the form so he can file it.

It's crazy--- want to hear other people's responses

I filed a waiver for unlawful presence, I've been living in the sttes for 12 years, do you thing that for over staying wih F-1 visa you will need to file a waiver? But if you really need it, its better to filed it before interview.

If you gonna send the waiver you can request to expedite and tell them you interview its april/28.
