Hello all, I had a question in regards to my pending petition.

I filed an I-130 petition on Jan. 29th for my husband. Received a receipt notice on Feb 7th, with a priority date of Jan 29th. I am trying to have the case expedited, due to the fact that my husband is currently back in Yemen where there is an ongoing conflict and extremely troublesome. My question is in regards to:

2 years ago while my husband and I were engaged, we had filed an I-129F petition for Fiancé. It was approved all that was left was to interview, unfortunately the Embassy in Yemen had closed consular services due to the outbreak of conflict. We never heard anything since, so we decided to just meet up in Jordan and get married, and file for the IR1/CR1 later instead. I am just concerned that we might run into a delay due to the fact that we filed for a K-1 prior. I did state in the application for the I-130 I did state that we filed previously...should I be concerned? Also, has anyone had any luck with the expedite process?

The previous K1 should not be a problem. As you cited there were embassy issues.

Expediting from Yemen may be slower than the typical expedite as the background check will have to be completed. It's one of those parts of the world where AP is practically a given.

So what embassy did you select Jordon, Egypt, Algeria? No US Embassy in Yemen. As far as expedite. You would have to expedite at USCIS than when you move on to NVC request another expedite and that gets sent to the embassy for them to approve.

The issue I see is you have shown that he can leave Yemen (many people asking for expedite under humanitarian reasons can not). You marrying in Jordon they may just say move there .

You can always try many people daily request expedites. Have your evidence together call USCIS they will tell you what is needed.

Also when you sent in your I-130 did you write a brief cover letter to officially withdraw your petition? It would be expired by now but it just a good way to show you are ending one to start another. But no issues.

Okay re-look at your I-130 Petition. Question 22 is where you write your embassy of interview. What did you put. Morocco is support fast but I am not sure which embassy Yemini folks can pick.

To dispatch with the semantics first, the I-130 is a petition form, not an application form.

To answer your question, you are not "doomed" on this; the NVC will route your file based on the residence address of the beneficiary that was provided.
