2nd RFE (this one "unofficial")

Ok, so on Friday my spouse and I got a second RFE, although this time with no text or official update on the USCIS website. This was a letter stating that our case was transferred to the USCIS San Francisco Office (which is weird because I live in the Northeast of the US...I thought they'd transfer it to our local office), along with three other issues...

First, they asked for a PETITIONER G-325A, along with a 2x2 passport photo of the PETITIONER.

Secondly, they said that my spouse's vaccinations weren't done in London (which they were and we sent the documentation the first time to support it and this wasn't even included in our first RFE) and they needed us to see a local Civil Surgeon to sign off on the vaccination report. I personally think they lost documentation and can't explain it any other way; however, to not delay the process even further I think we're just going to fork over the $100 to have a USCIS Doctor sign the form and return exactly what they're asking for.

Thirdly, they're asking us for evidence of a bona fide marriage... currently we only have a joint bank account and photos of us during and after the wedding.

And lastly, again they notified that we've been transferred to the San Francisco office.

Does anyone have an input on this? This is so strange...why wasn't any of this included in our first RFE?? We're so lost....any advice would be great!!

By the way, this is for a post-marriage I-485 AOS.

It's official, you got the letter.

If you think that it is in error then call USCIS to verify. Mistakes happen.

Now that's a real odd one. You'll have to respond to the RFEs of course, but I think making an Infopass is in order for this. They may be able to help you get to the bottom of it.

I forgot to add that they sent back my co-sponsor financial information saying that I made enough, even though the first RFE said I needed one. The government confused me from the beginning and continues to do so...

That sounds like they messed up. I hope you can get clarification with an infopass. Please give us an update here.

Very odd. If they do not have your case confused with someone else's, then I am not sure what is going on. Make an infopass and/or call and have it escalated to a tier 2 IO that can answer some questions about your case status and details.

They don't have our case confused with someone else's because they have my name (the petitioner) on it as well. And the correct file number. We've tried calling, but expectedly ...no help whatsoever! We're going to proceed with the instructions they sent us and fork out the $100 to see a civil surgeon today. We're going to send our joint bank account and many wedding pictures. Not sure what more they could want?!? I'm just hoping after all of this we won't need an interview! Asking for a passport photo of me (the petitioner) is so strange!

After all, why would they ship it all the way to San Franciso and then ship it all the way back to the east coast to our local office for an interview? Waste of time and money if you ask me! But we shall see. It just aggravates me that we have to lay out extra money for something that seems like a careless mistake...but I'm hoping that it will pay off! And we're planning/hoping this doesn't effect the EAD! My spouse is having major cabin fever!

Charlie, personally I would make an Infopass appointment. You aren't going to get the help you need via phone.

We'll respond to this RFE first and if there's any other issues moving forward, we'll do so. We can't be bothered to delay the process any longer. We'll give them want they want for now. It's just so frustrating.

Have you seen this checklist from the UK Embassy? It says a photo of both beneficiary and petitioner for the G325A.

I remember submitting a photo of myself as petitioner with the G325A.

I know this isn't for adjustment of status, but the G325A requirements are the same. You need a photo of the petitioner. I took a passport style photo at a drugstore.

Friend of mine from Miami got an "unofficial" RFE from San Fran in January. They wanted a G-325A from the USC, not the foreigner.... weird.... and relationship proof. They sent both and the green card was approved in a couple weeks. No interview.

I've seen several people on here lately report that they received RFEs from offices across the country from their local office. It seems that USCIS is sending waiver cases to whoever has the capacity to handle them... if only they would do the same for mine...

Sounds like it, I agree. They were probably pulled for an interview but then switched to waiver and they solve the backlog with these strange RFE's.

How is it different? The OP said I-485 post-marriage. That requires an I-130, correct? The checklist is for an I-130.

We did an I-130 for my husband who was already in the US and had to do consular processing, and it required a G325 for me as petitioner, complete with photo. Why would adjusting status with I-130 filed concurrently be different entirely?

Adjustment from a K-1 does NOT require an I-130. So yes, it is different. No G-325A should be needed from the USC when filing an I-485. And AOS within the US does not require consular processing abroad. It is done through the USCIS in the US.
