Hello Im a new member to this forum and I have a question. My wife is a K1 from the phillipines and she got here in Dec. We got married within the 90 days as per the requirements for the fiancee visa. Now its time to do the I 485 But I have some questions and sure could use all the help please.

My wife's I 94 in her passport has expired. How much time do we have to file for the AOS? It says we must marry within 90 days but I dont see a timeframe for filing this document.

My wife and I tried to get her SSN at the SSA office but they wouldn't let her get one due to her I 94 in her passport expiring in 1 week. The I 485 AOS document asks for a SSN for the applicant ( MY wife) Yet she doesn't have one. All she has is the alien number inside her passport that she was issued to her with her visa. What should I do if she has no SSN prior to doing the I 485 form? Is it required for her to have a SSN prior to filing this form? If not what should I add to that block on the form if she doesn't have one?

My last question....for now until I get more confused...lol....were can I find an example cover sheet for the I 485 packet I will be sending in? I was wanting to have a nice, organized cover sheet that states the documents inside her AOS packet in order. Where can I find an example on how to make one up?

Again....thank you very much for all the help! I have to do this document on my own as hiring a lawyer is not feasible due to funds and high costs to hire them. I want my wife to stay here and dont want any problems from INS. Thanks for all the help here!!

Lawyers are usually a waste of $$$. From what I understand, there is no timeline for filing AOS.

Oh, also: my husband did not have a SSN when we filed AOS either. We still filed.

5/23/03: Justin arrives to visit me in IA from SK.
6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

e. Copies of the intending immigrant’s international birth certificate and passports

i. Biographical page of current passport

ii. Biographical page of invalidated passport

f. Certified copy of marriage certificate

g. Form G-325A (all four pages) filled out by the U.S. Citizen, signed and dated

h. One passport-type color photo of the U.S. Citizen

i. Form G-325A (all four pages) filled out by the intending immigrant, signed and dated

j. One passport-type color photo of the intending immigrant

k. Three color family photos along with a third party letter of support to establish evidence of an ongoing marital union between the petitioner and the beneficiary

2. I-485 Package

a. Cover Letter

b. $395 check for Form I-485 and biometric services payable to the Department of Homeland Security

c. Form I-485: Application to Register Permanent Residence or Adjust Status

d. Copies of the intending immigrant’s passports

i. Biographical page of current passport

ii. Biographical page of invalidated passport

iii. Copy of F1 visa

iv. Copy of entry stamp

v. Copy of I-94 (front and back)

e. Copy of EAD, I-20 and Certificate of Completion issued by City College San Francisco as evidence of the intending immigrant’s F1 Student Status

f. Copy of the intending immigrant’s international birth certificate

g. Certified copy of marriage certificate

h. Two passport-type color photos of the intending immigrant

i. Form G-325A filled out by the intending immigrant, signed and dated

j. Form I-693 for intending immigrant seeking adjustment of status (in sealed envelope)

k. Form I-864 Affidavit of Support

i. Copies of Federal individual income tax returns for 2006, 2005 and 2004 along with every Form W-2 and Form 1099 that relates to the submitted returns

ii. Pay stubs from the last six months

iii. Employer letter
