I applied for adjustment of status a few months ago, we sent the I-864 form filled by my father in law who was going to be my sponsor, since my husband didn´t had a job at the time. Now USCIS has requested my husband to file an I-864 as well since he is the petitioner but he didn´t filed taxes for the last years. He was a student and he had some jobs, which we stated in the g-325a but since he doesn´t filed taxes i wonder what can we do ? I know he must make a statement explaining why he didn´t in case he didn´t need to file taxes because his income was below , but since he had a job for the past three years but he still didn´t, what can we do ?

The petitioner is always the primary sponsor and must submit an I-864 regardless of income.

Complete the form and follow the instructions regarding not filing and submit a signed statement if applicable.

If he did earn enough to file a tax return and did not, then the back tax returns must be filed and proof of that filing submitted to USCIS.
