Hello,

Situation

Met online through religious matrimonial website March 2015

USC lives in New Jersey

DACA lives in St. Louis

USC works for major company in NJ and has to travel

DACA works for major company in NJ, no travel

Decision is that they want to live in St. Louis

Bought a house in St. Louis in January 2016

They want to start the AOS process by court marriage, having family members there etc.

Question is that USC will be looking for work in St. Louis, while visiting DACA person every other week, or vice versa, however not always in St. Louis due to work HQ in New Jersey and work travel on-top of that.

If they apply and do not have luck in acquiring a job for USC in St. Louis, and show proof of house, joint accounts, health insurance, constant communication etc. etc. what issues should be assessed for during the application and interview?

More details can be provided, looking for constructive discussion

Regards,

Positivenergy

First of all, did you make sure the DACA person qualifies for AOS? i.e. did they enter the US legally?

I am not sure exactly what issue you are asking about. Are you asking if it's okay that they are living apart? It might make it harder but if the separation is temporary and for job reasons it's understandable.

The proof of joint accounts, joint insurance policies, joint purchase of home is good to have for all marriage based AOS. Since living separately, I would also recommend showing that work status on check stubs went from single to married and flight/ticket records showing that USC is in fact with spouse every other week. Also photos of wedding ceremony, even if at court, of ceremony and with family members as well as any celebratory event after (example: My husband and I took everyone to a small dinner/reception at a local restaurant after court wedding and took a lot of pictures with everyone).
