Hello,

I am a Canadian who met my fiancé while on a B2 visa. I didn't know him prior to entering the US so applying for a K-1 visa would not have been possible. We would like to get married next week however, I would like to ensure that I am not overstaying my allowed time in the US (my B2 visa expires in 3 weeks). After we are wed, am I allowed to stay in the US while I apply for AOS? When should I apply for AOS?

Your assistance and advice is appreciated. Thank you kindly!

overstay is forgiven when married to a USC.. i overstayed and got approved on the spot! it is OK to overstay:) just do not leave the country until you get your GC!

B2 suggests other issues.

Canadians don't need a visa to visit the US. The fact that OP went through the hassle of obtaining a B2 suggests something else might be at play here.

KierenHby - Yes, Canadians do not require a visa to enter the US and I never said I "went through the hassle" of applying for one. After I entered as a tourist, my passport was stamped with B2, which all Canadians get upon entering the US as a tourist.

Nothing else is at play here. I'm simply asking using this forum as a way to obtain advice from others who share a similar experience.

This what I was commenting on plus it is unusual for Canadians to have B2 Status.

As he closed my passport he realised his mistake as I have a UK passport, crossed out the B2 stamp and re-stamped it with WT for 90 days. He muttered something about having assumed I was Canadian.
