1.We are filing concurrently for My (citizen)wife's parents who are already in the united states on b-2 visa. The instructions basically say AP is issued for two reasons " urgent humanitarian reasons and "personal or family emergency" What? That doesn't make any sense. How can I know of an emergency that hasn't happened yet? what do I put on the application? It also states "vacation" is not a valid reason.They want to go to get there financials in order.

2.after we get the green cards for my wife parents, If they want to travel back to Russia for a small amount of time, what do I need to apply for ? is it a re entry permit? or is the green card itself the re entry permit?

1. I don't believe you need a specific reason, ppl apply for AP all the time without any kind of emergency.

2. Short trips don't require re-entry permit, only the valid GC.

Thank you for the quick response. can some one guide me on what to send them? Am I missing something? does it asks for this but everyone just ignores it? The application instructions state "

You must complete Part 4.of the form indicating how your intended travel fits within one of the three purposes below. You must also provide evidence of your reason for travel outside of the United States including the date(s) of travel and the expected duration outside the United States.

Below are examples of acceptable evidence:

educational purposes

(a) A letter from a school employee acting in an official capacity describing the purpose of the travel and explaining why travel is required or beneficial;

or(b) A document showing enrollment in an educational program requiring travel.

employment purposes

A letter from your employer or a conference host describing the need for the travel.

Humanitarian purposes:

a)A letter from your physician explaining the nature of your medical condition, the specific medical treatment to be sought outside of the United States, and a brief explanation why travel outside the U.S. is medically necessary; or (b) Documentation of a family member's serious illness or death.

I personally never filed I-131, but I see ppl here on VJ file it all the time with their AOS packet as a matter of course, without any specific reason, basically just in case they need to travel before GC is in hand.

The part you cite is actually talking about DACA recipients - NOT applicable to your case.

ah yes your right EM the last part was for DACA, good catch! under the instructions, part 3(a)1 (applying within the united states) it does state that it needs to be for humanitarian reasons or a significant public benefit or a family/ personal emergency, or "bona fide" business reasons. Can any one clarify this part. It almost sounds like they just dont enforce there own rules. I was just going to put "family obligations" under the reason, but maybe I should change it to something else? Has any one filled it out from a tourist, business visa to I485 that has experience on what to put?

If you are in the United States, you must attach:

(1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and

(2) An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole Document; or

(3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application; or"

So basically it seems that having filed for AOS is pretty much enough reason to grant AP. Family obligations is fine for a reason.

Can any one clarify this part. It almost sounds like they just dont enforce there own rules. I was just going to put "family obligations" under the reason, but maybe I should change it to something else? Has any one filled it out from a tourist, business visa to I485 that has experience on what to put?
