Hi All:

I am getting ready for filing I-751 for my wife. I am not sure if I have to use any Lawyer's help filing the application with lot of uncertainity on what needs to be includes. My situation is simple, we both are still married and had one child a 1.5 years ago already (after she came to US). Bracing up for second child end of this month. I can provide

Tax returns for 2014 and 2015 filing jointly

common bank stmts from last one year

common auto insurance

Home is only on my name, I bought before marriage and difficult to add her name with mortgage stuff

common utilities

both names in medical benefits

Driver licenses with same address

Child 1 Birth certificate with both of our names as parents

Child 2 birth ceritificate with both of our names as parent

I added her into my 401k as beneficiary from the time I got married

Just added her into Auto loan (but not in the title yet)

can provide two reference letters from those who know that we are married and live together.

Can add pictures taken together

What I do not have

house name/lease on both names

only my name on two vehicles (bought one vehicle last year but did not add here name as interest rate is getting too high)

Added her name also into Auto loan but only this month

Just getting added her name into my stocks account ( I just opened only last year)

We had to use lawyer during I-130 approval after RFE after the interview - but that was cleared later and she came to US in 2014 and living with me since then.

I asked for lawyer fee, they are quoting around $1400 for this application.

Question is do I need Lawyer in my situation or I can file on my own. It would be difficult to cope up with any RFEs while we are handling two small babies (1.5 years old we had and the new born) at at home.

Sree, in my opinion, you do not need a lawyer. What you do need 1) a letter explaining why your house is in your name only and why you have added her to your car loan so recently; 2) if you have them, bank statements showing joint ownership since you married, or since you added her to your bank accounts.

In clearing ROC, you must send data FROM THE DATE OF YOUR MARRIAGE - not just the last year, and not since POE.

Please make sure you explain everything that might seem different (only your name on the lease, car ownership) in your cover letter. Your explanations here are excellent. And truly - you have had two children since your marriage - that is pretty strong evidence!

Because you have a family, I would really suggest you both fill out wills naming each other as beneficiary, as well as planning for guardianship of your child(ren) should you and your spouse die at the same time. Please do this step - ROC or not.

Thank you Sukie and Happy Chic.

I have evidences for last two years. Did not have much before that other than we are continuing the Life insurance policy from 2012. Also 401K beneficiary from the marriage time (2012).

I was worried only because they sent RFE for my initial I-130 after interview in India. But then I took lawyers help providing more evidence and got it cleared.

I am not sure why they are looking for things again for the time of before their interview. They already saw all these earlier and approved. Since my wife is House maker (with 2014 delivery and pregnant again last year), we did not have much to show.

WE have two children from marriage and returned two year taxes "married filing jointly" - not sure why would they even look for any other evidence. What else would be stronger than this...

All others, if you can give your thoughts and suggestions, that would be greatly helpful.
