Hi, l live in the US with my boyfriend ( US citizens)with overstayed visa( 4 years ). The question is if we want to get mary and adjust my stay do I need to sent the waiver along with the other document? I asked attorney online and she said I need a waiver or I will trigger a ten years ban but after looked around in this forum, nobody said I need one. I'm so confused!

You dont need a waiver as long as you entered the US thru a port of entry and was inspected (got an arrival record) by an immigration officer at the airport.

Just get married, file i-130, i-485, i-131 and i-765

Follow the instructions what to include on the document list.

04-11-2016 - Requested an SR based on the 75 days pending application for EAD/AP

04-11-2016 - Text/Email Advice that EAD/AP card is being produced and to be sent to address on fle.

04-16-2016 - EAD/AP card received

04-18-2016 - SSN Card on hand

08-17-2016 - Received Text/Email for interview date scheduled for September 22, 2016

09-22-2016 - Interview approved. waiting for card :dancing: :dancing: :dancing: :dancing:

You can do it yourself. Just follow the guides on this website. Many people were able to adjust without a lawyer. If you are married to USC and have proof of legal entry you should be good.

Follow the I-130 guide.

You don't need no waiver nor lawyer to do this. It's a simple do it yourself following the guide. Sometimes I wonder where some of these lawyers get stuff like that. If this makes you feel any better, I was also out of status when I got married and filed for adjustment of status doing it solo and got approved without a breeze. Go and ahead and do your thing.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

3/14/2015: Green card delivered.

Removal of Conditions: 

12/14/2016: Mailed I-751.

12/19/2016: NOA issued.

01/26/2017: Biometrics.

05/03/2018: I-751 transfered to NBC.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

Or if you entered the US without inspection(illegally).

Op your case is pretty simple, if you follow the guides here you should be fine without a lawyer. Your overstay is forgiven with marriage to a USC.

My husband overstayed his tourist VISA by six years. Lawyers always tell us you must use an attorney. I think they are just trying to drum up business. Because with some research, common sense and a lot of very helpful posts made by others on this website I was able to get everything filled out myself and sent in. The only mistake I know I made so far is using ACCO fasteners lol. I misread the dont use them for the Chicago lockbox as use them. Hopefully it won't be a big problem. Good luck!
