Visa expires before AOS.

Hi guys. We just been having fun and traveling. Like I said in past post, we got married before the 90 days, but have not done any other paper work since. She has been here for about 5 months now and we were married 2 months ago. Her visa expires the 16th of this month. Do we need to hurry up and file AOS before it expires or can we still take r time and do it after? Thank you.

Yes, you can still file after the visa expires. The only thing is she'll be out of status until she does file the AOS.

Thanks, What does that mean? Will that be a problem? We r tripping to new York shortly too. Not sure if that will also be a problem with getting a ticket or will they just look at the passport expiration date?

That may be a problem, but unlikely.

Her K1 was gone as soon as she completed PoE. You can file AoS at any time, but sooner would be much better than later. It is unlikely you will have a problem traveling within the US, although I have seen instances where the lack of a visa/GC has caused a slightly delay during travel-but I have not seen a case where they have been detained or anything.

The visa was invalid after 90 days of entering the POE here in the USA. She is currently out of status as of right now, but that is not much of a problem if you got married. Just file for AOS soon and you will be fine.

As others have said the visa "died" at POE, legal status in the USA was granted by the I-94 for only 90 days from POE. If you are past the 90 days then your wife is out of status, if CBP wanted they could deport your wife. IF.

Once AOS is filed your wife has legal status while the I-485 is being processed. Why delay? Go have fun after you have filed.

Visa was invalid upon entry into the USA, at POE. Legal status was granted by the I-94 which is only good for 90 days from entry into the USA.

Thanks everyone for your help. No real reason for the delay. Just in no hurry to go back to the paperwork grind. We will file beginning of next week so there are no problems. R trip to New York isn't for a couple of months, but I need to get tickets this week to get a good deal.Once again thanks. This is a wonderful site. It took us 3 months from start till she was here thanks to this site. We met another couple a week ago that it took 11 months because they waited to be contacted and get final package. They didn't even know this site existed. A wealth of info and giving people.

You're good to go then. Just remember, when you are planning to travel after you filed adjust of status, bring a copy of your NOA-1
