That's good I'm very glad to hear that!

I thought family would be included when someone petitioned for you.

hi

this was a siblings petition, her mother was the beneficiary, she was the derivative. for siblings petitions, they only cover unmarried children under 21

she has a child, so grandkids aren't covered

she was granted a visa for being the derivative, but not her child

if her mom would have filed for her, then yes, her child would have come as her derivative

unfortunately what they gave her was incorrect information

Okay thanks for explanation! So she could file a I-130 for the child to come since she is a green card holder right?

You mentioned the father, are you married?

Yes indeed, there are always circumstances that force us to take painful decisions just to survive. Immigration is full of these cases, some one has to be a provider for a family.

Nothing to suggest that this is one of those cases.

My LPR brother is petitioning for his son. My nephew will immigrate to the US next year with his 2 year old son. He will get his green card and immediately return home to marry his son's mother. He will leave his son with his wife, the mother. He will return to the US to work and file for his wife. In a few years, they will all be in the U.S.

Is he abandoning his child? NO.

Guess all the US service people who leave for a year are abandoning their children too.

Get it through your thick skulls that there is no abandonment. People are only seeking help. Help that I will give them.

I am a greencard holder. Is my son eligible for following to join benefits? If yes, how long would be the waiting time? If not, what visa category will apply for him so that I can petition him? Thanks for the reply!

Your profile state you are an F4? Then you can petition your son using I130 form. How old is he, single, married- these are big factors on how long is the waiting time before his case become current. :)

He is no longer minor, otherwise he is included in your petition. The waiting time is very long for F2 and F3

Thanks for the reply everyone. Btw i just didnt left my son all alone in the Philippines, his dad is with him

File I-130 for your son as soon as you received your LPR. When you can and able to, go home and get married; go back to US - file for I130 for your husband. Then wait for the case of your son hubby to be current.

Then live happily ever after :)

I hope now it is already clear why your son was denied. Sorry for that.
