If i have a question regarding the Visa process and requirements for my 11 year son to enter the US with his Portuguese passport, who do i need to contact? Can anyone please assist me? I will be applying for a work Visa in order to enter. I have dual Citizenship. South African and British with Passports, and I am engaged to a US Citizen. Planning on getting married as soon as I arrive.

Trying for a work visa with intention of marrying is visa fraud

also work visa is hard to get

go for K1 financee visa

I am sorry if it came out wrong. We have been engaged for almost 2 years now and I was going to apply for the K1 but was offered a job as well so thought it may be easier that way. I am not sure how it all works. I just wanted to know what I would need for my 11 year old son to join me. Thanks for the reply.

What has your future employers immigration lawyers said?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

you don't apply for the work visa, your employer will and dual intent visas allow derivatives so he would come with you

or your fiancé could apply for both of you and forget about the job

A k-1 is easier, in my opinion. For bona fide relationships the acceptance rate is pretty much 100%, it's not subject to caps or quotas and for applicants based in the UK the process is currently taking around 4 months.

I don't understand why people with such a comparatively easy route into the country would even look at alternatives. I'd leave those for those that have no other option.

If a company has offered you a job there, they need to do the visa application for you. They do realise that, don't they?

A k-1 is easier, in my opinion. For bona fide relationships the acceptance rate is pretty much 100%, it's not subject to caps or quotas and for applicants based in the UK the process is currently taking around 4 months.

I don't understand why people with such a comparatively easy route into the country would even look at alternatives. I'd leave those for those that have no other option.

Usually a work visa is quicker, simpler cheaper.
