I have a question regarding doing the i-130 and i-485 for adjustment of status for a good friend of mine. He being the USC married a Mexican citizen while she was visiting in the US on a visitors visa. He wants to do a AOS for his wife. Her visitors visa expires in the year 2023. Her Mexican passport will expire in two months. By the time they mail in the paperwork her passport will be expired. Should she renew her soon to be expired passport?

She'll need to provide copies of her biographical page and entry stamps though which would be consistent with the I-94 she'll need to attach as well.

I'm assuming that the Mexican consulate will not give her passport back once they take it to renew it.

I don't think it'll be an issue that her passport is expired since they won't be issuing a visa (which requires that you have a min 6 month validity left on your passport).

A valid passport is not required to do AOS. However, she should probably renew her passport, because it's probably the only federally-recognized ID she can get at this point, and she will need an ID to do things like take planes or even get into federal buildings for USCIS appointments.

Would her tourist visa be a federally recongized ID?
