We are about to file for AOS from F-1 but we have a question. My wife(the USC) took upon my name when we got married but all her documents are in her maiden name. Only a couple of them are actually in her new married name. We have been debating as to what to do. We do not want to confuse the USCIS officer but this is our situation.

USC wife maiden name: Jane Doe
My name: John Bo
The name in the marriage certificate: Jane D. Bo

But all our joint evidence and her state Id's and passport show her maiden name as Jane Doe.

What name should we use in the I-130, I-485 etc(We are filing concurrently). Do we need to get her name changed in ALL the evidence of bona fide marriage we have( we have a lot, we have been together for 4 years) This is what we have

1. Joint Bank Account- 12 months(although we had more than that, our finances were co mingled before we married)

2. Joint lease for the last 4 years(for 3 different residences)

3. Joint Credit Card Statements(12 months)

4. Joint Car Title

5. Joint Car Insurance(Copies for the past 12 months)

6. Joint Rental insurance

7. Joint Internet Bill(Past 6 months)

8. Joint Electric Bill(Past 6 months)

9. Married filed jointly IRS Tax return Transcript(2015)

10. About 50 pics together, along with some with her kids included(we have no kids together and I never had any kids prior)

11. Copies of flights taken together

12. Cards addressed to both of us(mostly from her daughter)

13. Mail addressed to both of us

14. Drivers Licenses showing the same address

15. Her Life insurance with me as beneficiary

16. Pictures of Alaskan cruise taken together

Or should we get her name changed in our marriage certificate to her maiden name? We have lots of evidence and just dont want to lose it because of a name issue.

Confuse the USCIS officer? You really think this is the first time they've seen this? It happens hundreds of times a day if not thousands. Just fill out all the forms in her married name, and in other names used block put her maiden name.

should we get the new proofs changed to her married name or keep them the way they are?

It's not necessary, they'll understand. I also agree with the above, just put the maiden name in "Other names used". But, since she has officially changed her name, you might want to go ahead and start implementing that change on all your accounts.
