If you can't respond to an RFE in time...

I may be jumping the gun here, but I am freaking out about our RFE situation.

My husband was cited with shoplifting TWO WEEKS before we were planning on submitting the ROC. We retained an attorney with the hope that it would be resolved by the ROC deadline. It wasn't, so we submitted ROC on the last day we could (sidenote...OMG, don't do this!!); fully expecting to get an RFE for the court documents.

The case was dismissed without prejudice in September (meaning that they can re-rile the charges at any point in the next two years). We got the RFE last week, and when I called the court to request the final paperwork they told me that they were looking for my husband to serve him paperwork, that he has missed several court dates, etc etc. Cue a MAJOR freak-out on my part. I guess they decided to refile the charges, ugh!!

I have contacted my attorney again but haven't heard back. He has an immigration guy that I suppose we'll have to consult with again.

My major concern is that we have only until May 18 to submit the RFE. Given the galacial pace of my city's court system, I'm doubtful it will be resolved by then. What can I do???

I know this was a major fuckup on my husband's part...I know that it can have serious consequences. I'd appreciate it if we could stay away from that bit and focus purely on the RFE stuff....is this the sort of thing that an infopass appointment is good for? We literally live across the street from our local USCIS office (can see the sign from the bedroom window, lol) so it is not a major hardship to get there or anything.
