Hi Guys,

I need some advice. I just received my NVC Welcome Letter with a checklist of things I need to submit for the next step of this process.

One of my concerns is that I have filed Head of Household for the past 3 years on my tax returns.

I married my husband in October of 2014, but he obviously still lives in Guatemala and I have been supporting my son and I this whole time.

My husband does not have an ITIN #, so that is why I filed the same way again.

Am I going to have problems at the NVC for how I filed? Should I process an adjustment to my tax returns for the last two years before I submit all of my documentation to the NVC?

I am so concerned.

Any help would be appreciated.

Your only probably will be if you filed as Single..

Looks like you've been on the site for a while. You should search on here for getting TIN # for foreign spouse or use google. You can equally find that info in irs website.

You just have to search.

If you have been filing as Single then you should amend. Other than that, if whatever you filed showed that you are married then you should have no problems.

You shouldn't. I've had my taxes processed with H & R Block Premium office because my husband is not here yet; they listed me as MFS and I also was able to claim HOH. Your husband's name should appear on your return even though you are filing separate and they generally assign all 1's as his SSN (for the purpose of processing return).

I equally filed head of household and i know 2 other friends that did the same thing with no problem my wife is here and my other friends wife is here with not problem.. I think what they look at is the income bracket if it is above poverty line
