Guys, one more question. after we get married, do i just apply AOS right away or do i have to file the I-130?

You can file the I-130 and I-485 together.

STEP1: buy her a ticket to CA, apply marriage license and get married. Her being a holder of H2B saves you a lot of anxiety on processing K1 VIsa

STEP 2: Process AOS- follow the guide here

Yes. The I-130 establishes the relationship between you two. That gives a basis to the I-485.

Hey guys,

so my girl has H2B Visa she works in Guam and the visa will expire on May 2017. I'm planning to fly her here in the mainland and get married on December, i am wondering if i file the I-130 and the AOS together. Once her H2B Visa expires can she stay here in the USA while the paper is on process? or she will have to go back to her country to wait?

You didn't completely answer my question. How did she get an h2b for so long? When did she enter?

In any case, once you file for AOS, USCIS sends her a NOA1 she will start a new period of authorized stay until the application is adjudicated.
