I see the real reason for this request. The OP wants to avoid having her tell the true reason why she 'needs' to spend 5 months with the grandchildren....it's refreshing to see so many people so willing to abuse the B2 visa privilege.....to the OP....when are you due back at work?

Dang!! The woman is trying to do it legally. Some people came here quietly on VWP knowing very well they plan to marry,adjust and stay while other just stay here illegally. But OP's mum is trying to go through it the right way.Cut her some slack.

If your mum has stronger ties back home and she has compelling reasons why 3 months (from the VWP) won't meet the amount of time she needs to accomplish whatever she is coming here for, she might get a visa. Older people rarely get tough time. She should be honest and if it doesn't work out..she can just use the VWP and make use of the 3 months.

No you won't. No sponsorship needed for tourist visas. Your mother has to prove her eligibility herself.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

I will be sponsering her with all the relevant documents, she just want to spend few more month with her grand kids. I have second question, God forsaken if she is denied the visa , can she use her ESTA after few months ?

I have said this a million times in this forum. There is ABSOLUTELY no sponsorship for a visitor visa. NONE. She must apply on her own merits and her merits ALONE. Period. END OF STORY. I would LOVE to know where and why people think there is? You have NOTHING to do with HER visitor visa.

She wont be giving the reason as spending time with my child. she will be syaing like tourism and family visit.

Wow. It might be a language difference thing (or I might be overly suspicious) but that sounds like she IS visiting to look after a child but will be evasive with the truth at the interview!

Lets say her VWP goes away , there is scenario wherein her passport is expiring next year , can i reapply for ESTA next year with new passport and get her here for 3 months.

Will a new passport change who she is?

She'll still have to answer that she has been denied a visa, and she will lose VWP privileges for a while.

To be honest, I think she'd be better off staying with VWP visits, there are many people in India who will never have that opportunity and she should be thankful that she has the ability to spend 3 months.

One thing to bear in mind IF your purpose is for her to babysit for you. If she breaks the conditions of VWP then it's gone for ever. I'm sure neither of you want that.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Also a B2 will not guarantee her 5-6 months. Her time in the USA is determined by the CBO at her POE, so her time allowed could be 5 days if that is what the CBO stamps on her passport. With the VWP, she can at least guarantee herself 3 months.

It is amazing to me that someone would actively instruct the grandmother of their children, who probably knows little about the consequences, to lie, evade, stretch, or bend the truth to an immigration officer. Who would instruct their parent to do such a thing?

Perhaps one should put it to the lady this way: do you want to have a nice easy trip to see your grandchildren, which you can also keep doing from time to time when you miss them and keep your VWP eligibility... or do you want to destroy your hope of ever visiting the US and seeing those kids again?

You realize she could very well be given a few weeks or a month. Than what will you do. The time allowed the CBP will decide. Won't they find it odd she had a live VWP in her passport that she could spend 3 months on. Seems you all will be raising suspicions as to the why. I can't imagine going to interview and saying

I need 5 months in US". That's alot.

Also realize her ties are all in US with you. Only child in US. She is a widow. What reason does she have to come back to India, UK?

Please don't apply for the B2 visa! I made this mistake myself and got denied (because I couldn't show enough ties with my home country) and now I can NEVER travel with an ESTA (vwp) again.
(I'm now happily married and living in the US. But I'd love it if someone at warned me for applying for the B2 instead of the ESTA.)

Thanks members. I spoke to her today, she also refused attending visa interview. She will be travelling on ESTA . I appreciate ur suggestions. I have one question I submitted her DS160 yesterday. but never booked an appointment. I hope its fine ?
