need help!!!! newbie here......

i am just here in usa on k3, got a letter that USCIS lost our form i-130!!!!!!! so my question is:

1. do we MUST need to re-file I-130 to continue cr1 process?

2. can we ignore i-130, and file AOS directly?

3. K3 visa has two years valid stamped on passport, is it a temporary green card already?

3. any other way to apply SSN card if there is no p2 of i-130?

4. we will get married for two years soon, so can we just apply 10 years green card instead of re-file i-130?

i read on guides that we DO need a approval notive paper of i-130 to apply SSN card, that's why i ask help here.

1. Please let us know what the letter said verbatim - quote it.

2. No. For a K3 a filed I-130 is required to apply to adjust status, and an approved I-130 is required for adjustment of status to be approved.

3. No. A K3 visa is a non-immigrant visa. It is useful as a travel document for the next 2 years, but it does not get you LPR status.

3. A K3 needs an EAD issued by the USCIS to qualify for a SS card.

4. See #2 above - you're asking the same question again.

6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

we mailed i-130 and got p1 already, but from p1 to p2 went slowly, after a week i came here on k3, we got a letter from uscis and said they lost our file!!!!

so as my understanding, we HAVE to re-file i-130 and go on cr1 process and we have NO other option, right? i even can't do anything about two years green card, right? what a mess now!!!

I suggest doing whatever the letter tells you, file whatever form it says. It may also be useful to get some information by making an Infopass appt. You can do so at http://www.uscis.gov

I'm not sure other than that, but I'm bumping this up in case someone else can help you.
