Yes Ma'am you can. WHen you fill out the forms of AOS fill the new name that you want on your GC and in other names used, fill the one that is in your marriage certificate and the one in your passport or birth cert if they are different.

After you receive your GC go to the SS office and fill out the form wiht the new name thats on the card and they will issue one in that name. Remember that everytime you hace a change in the status you need to get a new social card and have them updated.

i called uscis yesterday and asked regarding chaning my middle

name into my maiden surname wen i fill out the AOS but they told me they will follow the marriage cert that i submitted together with my AOS, or the birth cert. but how would i follow my birth cert if i want my new name in GC the married new name. where in my middle name is the one i want to change. do u think all uscis are same? coz im from california

All USCIS offices follow the same rule. Now that you have sent your documents, wait for the appointment for fingerprints. At the ASC (fingerprint / photo office) you can request the head of the office to help you insert the name change. Caryy your marriage certificate and all other documents to help have your name put in.

thanks but the main problem is that my marriage cert middle

name is the one i want to change wen i filed aos, and i look at the forms in uscis about aos filling and it shows write ur legal name used and my legal name used in married name is the one i want to change the middle name and the other category is write ur name in aliases, do u think uscis would not get confused in the name i will write in the legal name they asked in the form if i put the name i want to have in GC and not in the middle name inhad in my marriage cert?

They will not get confused. Whatever is the name that you want as your legal name on your GC is what you have to state in the application. So if you wanted your maiden name as your middle name and you filled it out as a middle legal name, it is fine. As long as you have mentioned your other names in aliases it is ok.

Hey,

 

My maarriage certificate does not have a middle name and there is no middle name in my greecard also. I just wanted to change my name completely and they did it for me

sorry if i ask a lot coz i was just afraid that i might have RFE in doing that coz my marriage cert middle name was my mothers maiden name and i want in my GC wen i fill it out to be my fathers lastname wen im

single and then my husband last name coz i read that marriage cert is the legal document for name change, do u think USCIS will gonna follow the name i pit as a legal name in the forms for AOS or they will still gonna follow what is written in my marriage cert as my new name

People that don't have a field on their marriage certificate for the new name, can file their AOS doc's in their new chosen name. That is their way of choosing.

I believe otherwise you would have to get it changed in court, or during the naturalization process where I believe you can choose to do so (not in all offices however).

The current thread, which is a year old and has been hijacked twice, is now closed to further comment.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
