Hello everyone.! Can anyone on this site give me some information about the right time to start processing to remov my 2yr GC? My GC expired by june 20, 2016 and it says on the letter we receive to remove conditional 90days before expiration. So, if we are right can we start filling I-751 on this month March 20? I found a website to read more about removing conditional it says if you file early USCIS send you back your application, so we don't the right date to start filling I-751. Please if anyone incounter same situations on mine can you please help us.?

Additional questions. What should we send for filling I-751 to provide proof? how much the fees? How long the process to get 10year GC? Do they have interview and biometric too?

Check the Date Calculator on this site: https://www.uscis.gov/sites/default/files/dateCalculator.html

Since your conditional green card expires on 06/20/2016, you can file as early as 03/22/2016. The fee is $590, and it can take up to a year to get your 10-year green card. Yes, you'll probably have to attend a Biometrics appointment. USCIS will send you a letter telling you where to be, and what time/when.

Be sure you read the instructions here: https://www.uscis.gov/i-751, and don't file earlier than the 90 day window.

Thanks for the reply Ortolan. So, 03/22/2016 is the right date to send my application? Is there a possibility to get denied if you dont have much proof (evidences) filling I-751,? Because me and husband we dont have properties with both of our names, except income tax returns and joint account, we dont have any properties own so im afraid if we get denied.

Well, they will probably ask you for more evidence (an RFE) if you don't have a lot to send with your application. Check that link. It'll give you examples of things to send.

You can send copies of things like:

Rental agreements in both names

Utility bills showing both names

Phone contracts, showing both of you

Income tax transcripts showing both of you

Savings/checking accounts showing both of you

Go get a living will made out for both of you and have it notarized

Copies of drivers' licenses showing the same address

A few photos of you both together

Affidavits from friends that state that they've known you since you were married.

Basically they want you to be able to prove that you've mingled your finances and your lives.

After sending application how long the wait to know if my application was approved.? Because we plan to visit my country by may or june but im not sure if I am allowed while my GC is going to be expired. Do you know if I can travel out of US without 10yr GC?

Yes because they give you a 1 year extension.

The length of time depends on the service center.

No, not yet.! Sorry, but im going to read. I just want to confirm if 03/22/2016 is the right time to send my application? Or we can send a day before 03/21/2016? Sorry just a little bit confused. Thank you

Do not send it early. If they recieve it even one day early it will be rejected and returned to you.

Hi honeypie. Have you used the date calculator that ortolan linked to in his first response? That is the best way to know the exact date that is 90 days before the expiration date of your GC.

As mentioned above, you don't want to submit earlier but you don't have to submit on that date exactly either. In other words, if you can't use the calculator and you want to make sure you are not early, just submit your petition in early April.

If you don't have strong evidence, they'll send an RFE requesting more. If you can't furnish enough, there's a great chance you'll get sent a notification for an interview to attend with your husband. If the officer is satisfied at the interview, you'll be approved just like your adjustment of status interview ( assuming you were interviewed ). Send anything you can to show you guys have a shared life together, financial documents are the strongest but others can supplement to an extent.

Honeypie84, you're going to have to watch your timing carefully after you send your I-751, too, because 3-4 weeks after they've received your application, they'll send you a Biometrics appointment notice in the mail, telling you when and where your Biometrics Appointment will be.

To keep things moving along, you might want to wait to plan your travel until you get that appointment letter and get your Biometrics done.
After you've done your Biometrics, it can take up to a year to get your 10-year card. But you can still travel out of the country using your 2-year Conditional Green card if you have that NOA-1 letter that comes to you after USCIS receives your I-751 application. You will carry that letter with you, along with your conditional expired green card, when you travel.
That letter extends the validity of your Green Card for up to a year.
