Hi everyone. my aos package is ready to be sent out but as I go through all the papers for the last time,

questions arise.

I did look around the website while was preparing my package. I found out that many people sent in

biographical pages of their passports, visa pages with entry stamps and I 94.

The problem is I read the instructions of both forms(I-130 and I-485) and I did not see any part of those forms saying that

those documents are required. Did I miss those information? Can anyone give me some suggestions about this please?

or is it different for out of status applicants? I mean do I have to send them to prove that I came in the country legally even though they didn't ask for it.

or just send them in to support the i 94 number that I wrote down on the forms. Do I have to send extra papers because of my status?

I am sure they have my entry record but do they need document to support it??? it is very confusing.

The only thing I found on I-485 instruction is the no. 3 under Initial Evidence part. it said

an applicant needs to submit copy of passport page with non immigrant visa if you have obtained it within the last year

but I have been out of status for about 8 years.

so now I don't know if I have to submit all those documents. Actually I already made up my mind that I was not gonna send

them because I did not see them required anywhere on the instructions but now I am not sure

Can anyone help me please (F)

Thanks in advance

hi

yes they are required, you have to prove that you entered legally in the country. overstay is forgiven if you are married to a USC, but you have to prove that you entered legally to the country with some kind of visa, in your case a student visa

the visa is stamped in your passport, the i94 proves that you were inspected and that you were granted a student visa

if you don't send in any proof, one of two things can happen, you will receive an RFE, o request of evidence asking you send proof of having been inspected or you will be denied the i485 because they think that you entered illegally into the country, sending the approved i130 to NVC for consular processing in your country of origin

that's why you must send proof that you entered legally

I filed at the embassy, I brought copies from all stamped pages as I saw was required. They gave them back to me saying they already had them??? But as the poster before me said, they need to know you are in the country legally.
