Hello all,

I have been a long time lurker here in VJ. These forums helped me a lot when I filed my AOS in March of 2014. I received my conditional GC in July 2014 and am now preparing the documents for filing ROC next month.

My USC husband is in the military and he will be deployed during the summer so he will be away for much of the process. We moved to WA in Feb 2014 but he is originally from CA, where his entire family still lives. In August of last year I found an assignment in a government office in CA. It was my husband who encouraged me to try out for it since I had no luck finding a suitable job near the base in WA and it would only be for a temporary assignment. We felt that it would be a good thing to have this CA experience since he is getting out of the military late this year and we are strongly considering moving back to CA when he does. Either way I am looking at working in CA only until he gets back from deployment, which may be in September.

I know that USCIS frowns on couples living apart but here we are. I have the following evidence already gathered:

  1. 2 lease agreements in WA
  2. Lease statements
  3. Tax transcripts 2013-2015 MFJ
  4. Military dependent enrolment form
  5. Military dependent identification card
  6. Tricare health insurance proof of coverage
  7. USAA car insurance
  8. Joint checking account statements since Dec 2013
  9. Joint phone bill since Dec 2013
  10. Thurston County water bills
  11. Soldier’s Life Insurance with me as beneficiary
  12. Life insurance from my job with him as beneficiary
  13. Form designating him as beneficiary of back wages in event of death
  14. Forms listing us as emergency contacts of each other
  15. Boarding passes from visiting during our time apart.

Do you think I have sufficient evidence? I intend to submit all pages of the statements since even when we were dating. I know living apart is a major red flag but in our case it is a temporary situation.

I just filed my ROC and my husband and I are also living apart temporarily. I work in New York City and he is going to Medical School abroad. It is understandable that they scrutinize long-distance relationships more but, at the same time, it is normal for these situations to present themselves in this day and age when it is expected for both partners to build and further a career and sometimes great opportunities come up that force you to be apart for a bit. I think especially in cases where one person is in the military, it is completely understandable. Your evidence looks good. The main stuff is there. If you want to add more, I would include some affidavits from people who know you and pictures. That's secondary evidence though, so it's totally up to you. I did add an affidavit explaining our situation and when we plan on living together again.

Hi, thank you for your insight. There are so many horror stories out there that we can't help but worry about the randomness of it all. How long was your affidavit? When did you file and what did you include?

Another thing I was concerned about is that my husband would be out of the country and unreachable for most of the time the petition will be pending. I need to get it right the first time and hopefully avoid an interview. Thanks again.
