Hello.. Will I get denied if I can't provide an ITR of my fiance? I only have W2, his bank statements and accomplished I-134 form. I have read somewhere that ITR is required for self-employed while W2 is for employed (not sure with this). Hope anyone could explain this. Thanks a lot!

I think the most recent tax return is required. What about his tax transcripts? He can easily have it mailed to him in 5- 10 business days. It's best to have it on the interview to prevent any delays of your visa issuance. :)

He already requested his tax transcripts but unfortunately it isn't on his mail yet.. My interview date is on Thursday. Do you think we should have it rescheduled? Or push through with the interview? Thank you so much! And btw, original copy of tax transcipts are required right?

We submitted copies of tax renters from Turbo Tax. If he filed his taxes online he should be able to email them to you to print.

Good luck with your interview.

Probably 221g until you can show a tax return or transcript.

This comes straight from the Embassy Letter. A copy can be found here. Everything asked for from the EL is all that you need to bring to the interview. USEM has not asked for financials, as outlined in the below paragraph, for about the past 8 months BUT it is still in the EL and may be asked at the interview. Therefore, you should be prepared.

ITR's are not required but can be used in lieu of IRS 1040.

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge

or burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form may be

useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You

may also be asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and

wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to

substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

If you cannot supply the information as requested at your interview they will issue you a 221g. Once you respond with the necessary request within the 221g then your visa will be processed as either an approval or a decline. Most likely an approval..

Got it.. Everything's clear now. Thanks as always! Btw, I have seen you posted the new 2016 Poverty Guidelines. Will it be followed this 2016? Thanks

Those are the new guidelines and the CO's will be using them and not the 2015. So, yes follow the 2016 guidelines.

Why isn't your fiance providing a copy of his most recent tax return, but is including a copy of the W2? Very odd at best and asking for problems.

Embassy requires the most recent tax return and W2 (1099) from ALL.
