Unemployment benefits affect support?

I am a college teacher working at two schools. I thought I would have a contract for summer term but enrollment is low and I just found out I will be laid off. So I am half out of work. My work from the other school fulfills the 125% of the poverty limit requirement for support for my 129-F fiance petition but just one job won't pay all the bills so I am considering applying for unemployment benefits. Will this affect my the Embassy's view of my ability to support my fiance? Will this info even be on the support documents? I have received my NOA1 but not my NOA2 but I am praying it should come any day now since my NOA1 was received November 1.

Thanks!!

They will only see if you can qualify as a sponsor, not about your bills, etc...You already meet that 125% Federal Poverty Guideline, unless they ask you for more, you will be fine. ^_^

GOOD LUCK!

Is unemployment public assistance? Don't I have to prove that my fiance will not be a public charge? wouldn't it make sense that I shouldn't be a public charge too? Eek, am I going to become a public charge?

I do not think unemployment is considered public assistance because it is funded by contributions by every employer not by general tax dollar appropriations.

YMMV

As long as your income from your other job meets the 125% poverty guidelines, I wouldn't even mention any income from any other sources. Other sources are only necessary when you don't meet the poverty guidelines.

As a previous poster said, USCIS does not care about your ability to pay your bills. I doubt they care about you (the US citizen) receiving benefits. They are only concerned about the foreign spouse becoming a public charge.

The technical name of 'unemployment' is (in most states) Unemployment Insurance.

Unemployment benefits are not considered a 'means tested benefit'.

An immigrant can draw unemployment compensation themselves with no ramifications towards becoming a 'public charge'.

The receipt of unemployment benefits will not even be an issue you have to explain (if at all) until the receipt of it appears on your 2007 income tax return.

As long as your income is over the proverty line, it doesn't matter where it came from as long as it's legit.

Gone but not Forgotten!
