What do you mean? Can you expand please?

Well, CSPA says that the length of time the petition was pending is subtracted from a child's age when determining whether the child has aged out. So pending longer = more is subtracted from child's age = it takes longer for the child to age out.

For example, say you have a child who is 11 now, and you file a petition now, and the wait for visa numbers is 13 years. By the time a visa number is available, the child is 24. If the petition took, say, 2 years to approve, then the child's age will be counted as 24-2=22, which is still aged out. If the petition took, say, 5 years to approve, then the child's age will be counted as 24-5=19, which is not aged out, and the child can immigrate as a derivative.

Obviously a factor that needs to be considered when deciding who moves in which direction.

There has been talk of banning this category as part of CIR.

I agree, no reason for the US to allow siblings. 99.9% of countries don't have this category, we shouldn't allow it either. Just like we need to do away with the adjustment of status loophole for people who come here on VWP, visitor visas. student visas. NO one should be allowed in this country without doing consular processing
