Try for tourist visa while K-3 (I130) is pending?

what's a "visa waiver" program? Is there really something like this?

The visa waiver program affords citizens of certain countries meeting specific requirements to travel to the US for tourism or some limited business for up to 90 days without first obtaining a visa.

It is only available for those countries listed and some residents of those countries may not be eligible (for instance, if that person has been refused entry or removed from the U.S., etc).

1-22-07 DHS cashes the I-129F check

1-23-07 NOA1 Notice Date

1-26-07 NOA1 arrives in the post

4-25-07 Touched!

4-26-07 Touched again!

5-3-07 NOA2!!! Two approval emails received at 11:36am

5-10-07 Arrived at NVC/5-14-07 Left NVC - London-bound!

5-17-07??? London receives?

5-20-07 Packet 3 mailed

5-26-07 Packet 3 received

5-29-07 Packet 3 returned, few days later than planned due to bank holiday weekend

6-06-07 Medical in London (called to schedule on May 29)

6-11-07 "Medical in file" at Embassy

6-14-07 Resent packet 3 to Embassy after hearing nothing about first try

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

Just thought I'd add an update... my wife just called me about an hour ago. She went for the B2 visa interview at the Mumbai Consulate and was told that they could not issue her a B2 visa pending immigrant (I-130) filing as a rule - regardless of whether she had sufficient proof showing that she was to return to India after her short visit.

Seems the officers there were nice, and the officer that was interviewing her showed a lot of sympathy towards her situation and went twice to confirm the rule with colleagues and supervisors during her interview. Looks like they wanted to give her the visa, but just couldn't per directives they might have received.

While there might be differences in the way this situation is handled at other consulates, this is the Mumbai Consulate's view.

Wish we had good news, feeling like ####### right now knowing I won't be able to see her for many more months....

I am a US citizen and I recently married an Indian national in India ~2months ago. I have filed an I130 and received the I-797 NOA just a few days ago. I want to bring my wife here quickly as she has no family there.

I am thinking of starting the process for a K-3...

My question is....Can my wife apply for a tourist visa while a K-3 case is processing? or will this cause problems?

Also, can anyone tell me how long it would take at this time to obtain a visa via the K-3 process?

My husband and I married June 2005. He had to return to the UK as he was only on visa waiver (visitor passport). We couldn't file for our I-130 and K-3 directly as we were waiting for an international custody situation with my stepson. He returned on visa waiver that autumn and was told at the port of entry he was not to return without a proper spousal visa but they did allow him in for 3 months. They marked his passport. Again that was BEFORE we filed for any visa.

I-130/129F Approved - Jan. 10, 2007

K3/K4 Visas Approved - May 4, 2007

What do you mean they marked his passport? You mean they gave him the I-94? I've checked my husband's passport and nothing seems any different from any of the other times despite being given the same warning.
