Request for Initial Evidence on I-864 so confused

hi everyone,

can someone please answer the questions i have?

i concurrent filled the i-130 and i-485 with all the supporting documents for this (864.765 etc...)

my case was received on January 18th. and my biometrics was on February 26. however we got a notice of RFE yellow letter on march 4th saying the need more information to proceed on i 864.

my husband is US citizen with enough income, so so he is the only sponsor.

when we were filling the form , i forgot the type in information on page 3 part 4, the form does not have sponsors name,

I got a letter requesting, word by word,

1. form i -864, affidavit of support, was submitted: however: Page 3, part 4 of the petitioner/sponsor's Form I-864

list someone other than the petitioner/sponsor or Page 3, part 4 is blank.

Submit a completed and signed Form I-864, for the petitioner/sponsor listed on Form I-130 or form i-29F. Even if a joint sponsor will be used. Also, provide copies of the petitioner/sponsor's most recent federal income tax returns and all supporting documents (W-2, 1099s, Form 2555, and tax schedules)

2. Form i-864 affidavit of support was submitted from a joint sponsor; however the names listed on page 1 and page 3 are not the same. submit a completed and signed form i-864, from a joint sponsor, provide copies of the most recent federal income tax returns all supporting tax document and evidence of their status of the united states citizen or lawful permanent resident.

MY QUESTIONS:
1. I understand that the cause of this is I forgot the fill in those blanks. Will an updated Form I-864 and all supporting documents be enough for this?

2. I don't have a joint sponsor, my husband makes around 80K a year so is above the bracket, is this because I left those spaces blanked?

Submit a new I-864 along with income proofs and double triple check before sending out. Good luck.

It is a precanned letter so they are exactly same. They don't have time to type it manually so don't worry about it. Good luck.

thanks another quesiton we have with this it asks for our most recent tax returns the issue is i cant do my tax returns until my fiance gets her ITIN number, because when we initially filed the I864 i had copies since it was for 2014, now its 2016 and I wont have copies of 2015 yet,,

Totally understand your frustration! We received an RFE for not providing W-2's but we had sent 3 years of official tax transcripts; this should have been enough. They also said my husband's income did not meet poverty guidelines when he makes $60K, so I re-sent everything again with a printout of the poverty guidelines, highlighting the requirement for 2 people. Lastly, I sent a copy of the 2015 W-2 with a note stating that our 2015 taxes could not be submitted yet.

Re: ITIN number and filing taxes - when you complete your tax return, you must also complete Form W-7 and attach it to the front of your tax return. Your tax return cannot be e-filed. Send the tax return to the address on the W-7 instruction form, NOT the regular IRS address. Go to this link for info: https://www.irs.gov/instructions/iw7/ch01.html

07.22.2019 Online application; USCIS estimated completion Sept 2020

07.31.2019 Biometrics complete

12.18.2020 Contacted State Senator (I-751 pending for more than 2 years)

05.10.2021 Interview  - recommended for approval

06.03.2021 Oath day...finally done!!

thanks yea the problem with mailing in our tax return and w-7 is they want my wifes original passport, not a copy
