hi guys..is my first time here on this forum.. i need some help with everything...lol ..me and my fiance will start soon the papers for k1 and joined this forum because here are alots of people who are in my situation or they been trough this and i felt like i need somebody who i can talk to about this things...my baby is in USA and im home in Romania and i have a hard time with everything and i was hoping to find here some friends who i can talk to while we are going trough this hard time.. have a good day to everybody...thanks

You will get a lot of support here on VJ, as many people here are separated from their loved one, and so they totally understand what you are going through.

I have been in the US for almost 3 years now, but before I was able to move here, I saw my fiance (he's now my husband) every single weekend. We only lived 3 hours from each other (me in Canada, him in the US). We were more fortunate than a lot of people who live thousands of miles from each other. I missed my fiance so much during the week, but always knew I would see him every single Friday night for the weekend. I do sympathize with everyone who wasn't as lucky as we were.

I hope you get a speedy approval and can be with your sweetie as soon as possible.

Thank you all!! Im glad i found this website..i will start to add more topics. Im not sure now when we will actualy start with all proces. we just talked to lawyer and my fiance needs to get his divorce straight..he was married before but they dididnt signed the final divorce papers yet..he divorced 2 years ago.. now he will get all papers done and we will start with everything...im so excited and very worried in same time. i have a question...can i apply for a tourist visa while we do all this? and if im denieded it will afect my k1 visa paperwork??

Welcome to VJ! :D There is a lot of info and support in here.

Before submitting the petition, your fiancé needs to have his final divorce papers as they are required as part of the evidence. You both need to be free and able to marry.

I don't think that you can obtain a tourist visa after the petition has been submitted, you would need to wait for your K-1 approval to come to the US. (I am not completely sure about this). Maybe it's better if he could visit you? Also he needs to show evidence that you have met in person within two years.

Hi ..thanks for you messages.. he is geting his divorce papers soon so we will need to start with our paperwork.. About him to come here..that's kinda more complicated..he is self employed and he dosent have so much time.. he said he will try but is not for sure he will be able..well we have alot of time appart..we will figure something out..and evidences that we been together we have because i lived in USA for a year and half..and i just came back two months ago... i was wondering if visa is enough for evidence that we been together in last 2 years...? thanks guys

Your visa to the US only proves that you were given permission to legally enter the country. For the K1 visa, you need to prove that you and your fiance met within the past two years . The stamp in your passport you received when you entered the US is a good piece of evidence. Also this is where plane, train, bus tickets come in, hotel/restaurant receipts, and photos (digital w/ the date printed on them, is the best if you have them). If you worked while here, paycheck stubs are good proof. If you lived w/ your man during your time here and both of you were on an apartment lease, for example, that is a good evidence. Mail for you (and him) delivered to your common address is also good.

Think about it this way....the person who will be deciding on your petition does not know you....he/she is only looking at the information you have sent in w/ the application. The "burden of proof" shall we say is all on you. The K1 petition instructions say you have to prove that you and your fiancee have met within the past two years prior to sending your application in. So all your evidence needs to go towards proving that to a complete stranger who does not know you/your relationship personally.

A visa and entry stamps only prove you were in the USA. They do not prove you met your boyfriend.

You can apply for a visitor visa before the petition is filed, however there is a chance you would not be admitted on that visa AFTER the petition is filed. In either event, you do not want to answer the question "purpose of visit" with "to visit my fiance". This will indicate immigrant intent. Once admitted, don't overstay your visa.
