B2 visa, do I need an I-131

Timeline

My passport does not expire until 2024, but I am entered on a B2 visa that just expired last month. I recently got married and we are about to submit our AOS concurrent filing packet within the next couple of days. However, we are wondering if I need to submit the I-131 with the packet just in case (no plans to leave) I need to return to Jamaica during application processing. I don't want to "abandon my application" but also don't want to submit an unnecessary document. Please help!!

Send it, you never know, see my thread "AP a warning". Its one bit of paper, 2 photos and costs nothing, why wouldn't you do it??

BUMP: Ok, I got the information wrong, The B2 VISA is not expired (good until 2020) but the I-94 has expired. Do we need to submit the I-131 with the AOS packet just in case (no plans to leave) Heem needs to return to Jamaica during application processing. Don't want to "abandon the application" but also don't want to submit an unnecessary document. Any help would be appreciated.

File for AP it's free costs nothing just a some minutes to fill it. Your green card might take longer and you may need to have it to temporarily leave the U.S.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

You cannot use your B2 to reenter the country when you have an immigration petition being processed, and it will be abandoned if you leave the country. What will end up happening if you leave without an AP is that you will have abandoned the AOS process, and you will no longer be eligible for admission with a non-immigrant visa, and you will have to start the CR process outside the country, which could take years of being split apart.

As you can see, the outcomes can be very bad, so I agree with everyone here, DEFINITELY apply for the AP, you have nothing to lose and a lot to gain.

11/2014-2/2015: We collected letters of support from Family

2/15/2015: Last DS-2019 was received.

2/27/2015: Sent I-612 + Affidavit and supporting documents (This was sent to California Service Center)

3/4/2015: USCIS received I-612 and sent Form I-797C notice of action in mail which I received later on.

4/9/2015: USCIS requested another non-USCIS advisory opinion for Form I-612

4/14/2015: From I-612 and I-613 were received by the DOS

5/6/2015: DOS: Post input: received,

6/27/2015: DOS decision turned to Favorable recommendation, Recommendation sent on 6/26
