Hello. Regarding the I601a ... What should you do if you don't seem to have a lot of hardships? For example, the only hardships that you have are financial commitments (car payment, furniture payment, etc). Like, say for example, you just pay rent; you don't own a house. And let's say you only work like 25 hours a week right now because there aren't a lot of hours. You could use that, right? And you could use the fact that your job is unable to give you a transfer to Mexico in case spouse were to be refused a visa. You could also use some arguments about lack of safety in Mexico.

Also, for example, what if you don't really have family? Like, you don't have a relationship with your parents, and your aged grandparents aren't sick, aren't needy of any help, you don't really any any commitments?

And as far as health is concerned, say for example you really don't have health problems. What are some ideas to make the most out of the few hardships that you have?

Thanks!

Everyome has hardship think

Financial............prepare a statement of mthly

Parents .............may not be ill but you help them with things to be done that they would pay for on fixed income

saying you have no relationship with parents will send the wrong msg.

Coumnity ties............Things you do within your community or church

Medical............If you had a recent bad cold you can show the doctors visit & meds for it

Show why both cant move back to beneficiary country

sub standard health care , education for kids (if applies), crime there, unable to work there

& no place to go live there

There is probably a travel advisory on Mexico. If Mexico is unsafe for anusc, it is also unsafe for a USC spouse. I am sure you will probably worry about your spouse is he/she were to remain there. What is the job outlook in your profession in Mexico? Can you support yourself here and your spouse if he/she were to remain there? How often could you visit there? Would visiting there cause you financial strain? Do you have children from a previous spouse here? Can that child move with you to Mexico? If that child can't move with you due to custody issues, that is a heart wrenching hardship to you. Does your spouse have a relationship with any of your kids? So you have access to health care in Mexico or adequate health insurance? Is there hazardous duty pay there for DOS workers? Local customs culture or sentiment of Americans? Do you speak Spanish? Etc

You can use the above link as a guide. Scroll down to the info listed for "Filing a Waiver".

Instead of thinking about what you don't have think about what you DO have that you wouldn't want to lose. Have a good waiver attorney help you.

Hi everyone. Sorry I have delayed my reply. I've been busy. Thank you all for your pointers. Honestly, they really help! Sometimes we don't think we have so many hardships, but it is possible to make mounds out of molehills, I guess. And sometimes we really don't have a choice, do we? Thanks!!!!
