OP is Nigerian. Traditional marriage is mentioned. Neither of these is definitive, but both are suggestive.

Timeline

Ask your friends what is their plan when the DNA reveals that he is not the biological father?

That's exactly what I mentioned. If DNA is asked for. Results come back is a "You aren't the daddy" an automatic denial.

I would either label the Mother as a liar and a cheat. Or label the father as a child trafficker. Like What a mess.

They ( both parties ) are claiming a biological relationship that doesn't exist. lies; lied; lying

Ok they have that one nailed.

Trafficking of children is a form of human trafficking and is defined as the "recruitment, transportation, transfer, harboring, and/or receipt" of a child for the purpose of exploitation.

Only because there is no proof they are exploiting the child.

Why not call a spade a spade.

Sorry I didn't mean "I" would as in me. I meant if a DNA is done and of course husband is found not to be the father mom might be deemed a liar, or a cheat (as in she cheated on him) since immigration doesn't know the whole story.

And the Trafficking I mentioned because of have heard of cases (2 I know of) where the father petitioned who he though were his children and when DNA was tested he was found to not be the dad(Lord I ear Maury in my ears now. Sorry). They were older in their teens but well was wondering. Seems this all can result into a lifetime ban.

I hope they decide soon they have a interview soon.

Correction. I am not Nigerian. I am married to a Nigerian, However this is not about me. I truly am posting for a friend who is Nigerian and so is her husband.

Timeline

If you are a U.S. citizen and the father or stepparent of the child or son or daughter, you must file the following with the U.S. Citizenship and Immigration Services:

 Form I-130, Petition for Alien Relative

 A copy of your birth certificate or U.S. passport

 If you were not born in the U.S., a copy of either:

 your Certificate of Naturalization or Citizenship or

 your U.S. passport

 A copy of the child's birth certificate showing the child's name and the names of both parents

 A copy of civil marriage certificate showing the names of both parents, or proof that a parent/child relationship exists or existed (if you are petitioning for a stepchild, your marriage to the child's parent must take place before the stepchild's 18th birthday)

 A copy of any divorce decrees, death certificates, or annulment decrees that establish the termination of any previous marriages entered into by you or your spouse

 Fathers petitioning for a child born out of wedlock must provide evidence that a parent/child relationship exists or existed. For example, the child's birth certificate displaying the father's name, evidence showing that the father and child at some point lived together, or that the father held out the child as his own, or that he has made financial contributions in support of the child, or that in general his behavior evidenced genuine concern for and interest in the child. A blood test proving paternity may also be necessary.

 If anyone's name has been legally changed (if it differs from the name on his or her birth certificate), evidence of the name change must be submitted.

In situations where the natural mother and/or father is an LPR, but the step-parent is a USC, the child can avoid family 2d preference backlog through the step-parents petition.Example: Andrew is a U.S. citizen and Stephanie is an alien from France. Stephanie has a child, named John who is younger than 18 years of age, from a previous marriage that she has custody over. Therefore, if Andrew and Stephanie get married before John turns 18 years of age, Andrew will be able to establish a legal step-parent/child relationship with John.

Normally, a step-relationship terminates when a marriage ends, especially if it ends in divorce. [Matter of Simicevic, AFM 21.4 (d)(2)(B)] However, under certain circumstances, a step-relationship may continue after the death of the natural parent or even after the legal separation or divorce of the step-parent and the natural parent if there is an ongoing relationship between the step-parent and the step-child. If the marriage ends in annulment, however, the step relationship is deemed to have never existed because, legally, the marriage never existed. [Matter of Pagnerre, Matter of Mowrer, and Matter of Mourillon]

You are totally missing the point of this thread. This thread is about a step-parent petitioning a child but acting like it's their biological child with false documents.

As stated before a step-parent has no issues petitioning a step-child. They fully note it on I-130, relationship Step-daughter, Step-son. On the G-325A the biological parent is listed not the step parent. If it's the step parent putting themselves down as the father that's a big misrep, fraud.

There's also the big the issue of the falsified birth certificate. For the child to take the step-fathers name there has to be court documents to show it. If we can therefore just get birth certificates with any parent name. Please let me change mine to Bill Gates or Warren Buffet as my father. It's not that simple.

All that needed to be done was them getting a birth certificate that was correct. Babies are born out of wedlock every day. My daughter was and her father is not listed on her Birth Certificate. If they didn't know the fathers name after all this time unknown could be used. The step-father would have no issues.

I know many US citizens who have petitioned their spouses children (their step Children). We have a member here just did it petitioned her husband and 3 step-children. Never was there a lie or false papers. Interview was fine and easy approved no DNA no issues. They are happy in US now 4 months.

As the title states this thread is about a Step Parent (father) Petitioning a step-child claiming the child as their biological child. :oops:
