Ok I have a few questions for the experts. Please only those that really know answer. My husband came in Feb. 2015. His mother had a stroke in the summer and he needed to return in Oct. 2015. He only purchased a one-way ticket to Kenya, and hoped to return sometime in Dec. 2015. Well it didn't happen. In Feb. 2016 a few weeks ago he had a ticket purchased but due to miscommunication he didn't board the flight so now he is stuck there til he can raise the money to purchase another one of unsuspend the current one by paying the fees. So my questions is this....His green card expires in Feb. 2017, so 90 days prior would be around Nov. 2016. He is hoping to return soon but trying to raise all that money may take some time. We haven't co-mingled a lot. We do have our lease agreement with our names on it. But if he gets back say....a few months prior to Nov. will he;

1. Still ROC 90 days prior to his Feb expiry date of his 2017 green card?

2. Will USCIS send him a letter saying that his 90 day will not be in Nov because he has been out of the country so many months?

3. Will all the time spent outside the US be added at the end of his ROC timeline? Explain when the ROC will need to be filed and possible docs required

4. With so much time outside US will he be allowed to re-enter it's been 4 months and counting?

5. Please advise on anything else that I may not have thought of.

Yeah I tried to tell him but he wouldn't listen he just had to go home to check on his mom. He said life here was stressful and he needed to rest also lol lol. But what can I do really! So currently he was here 7 months now gone a little over 4 1/2 months. I don't know when he will have the money 2 purchase another ticket. But he took that risk I guess now I wait to see what happens next I guess.

I think you and your husband have some deeper communication issues. At 6 months he is at risk of losing his green card and it only goes up from there.

Just curious... Why aren't you buying a ticket for your husband to return? I don't understand why you are saying that He needs to raise the money. That would mean he has to work over there, which looks like he never intended to make the United States his home.

Thank you for your concern. I don't mean to seem rude but did you read my posts? I said two weeks ago a ticket was purchased for him to return on the 15th of Feb. He didn't get on the flight,. Now that the 29th {a date in his mind}, has come he wishes to return. In my post I also said he was stressed here, fearful of his new life, and needed to go home to rest. He had a very hard time adjusting to marriage, jobs or the lack to find one right away, snowy weather, so many things. I purchased his ticket the first time, and a friend purchased it 2 weeks ago. He didn't take time to consider that if he didn't board the plane on the 15th what would be the outcome of a non refundable ticket, so it was wasted. I was not trying to put to much emphasis on the journey just know that it has been very painful, but God is able to work everything out that need to be fixed. My questions still remain on the ROC because truly I have done all I can do for the return ticket, he has to recover the cost of the ticket now. Looking at the possible least to the greatest scenario. Thank you so much for asking

I can only pray and hope for the best regarding the 6 months issue. He knew he had to return before that time but as I said he was so fearful of life here {very long story}. Nothing wrong with the communication, he is a cultural man and the tribe that he's from they are the only "boss," the wives are to obey. So he's in charge and I am suppose to just submit!

Being away between Oct 2015 - Feb 2016 won't be too much of an issue since it's about 5 months. But he has to come back now to avoid potential problems. Coming back a few months before Nov 2016 will definitely raise big red flags and will certainly look like he's coming back just for the removal of conditions, and not to be with his spouse.

So do you know the answers to my questions?

Can any of the original questions be answered. I understand the red flags and the lack of a ticket but what about the questions that I have asked?

That kind of cultural change is what you need to communicate about. You need to decide where your limits are and communicate those.

Dont be a doormat.

1)yes

2)no

3)no

4)possibly

5) greater questions to ask will the ROC be approved even if filed for. The answer is unlikley.

6) how badly do you want to be married to a man who doesnt even want to be here for you if this is where you need to be

7) is moving there a better option for you should you want to be in this relationship

Not to be rude either, but are you actually reading the reponses? You've got more trouble on your plate than trying to ROC. Pretty apparent he isn't interested in life in the USA.

Seems like you already know the answer to your questions - obviously you could face problems if he doesn't come back soon as a GC is for living in America. If he cannot commit to the life here then mayby you two need to consider perhaps his country? I really doubt you buying a ticket for him and he didn't use it has any kind of "good news" to your ROC. Sounds like all you can do is to try get him back, discuss the future, then move on from there and see what ROC brings you but one thing I could almost ensure you is - the longer he stays out of the country and away from you the harder ROC will be.

Whether or not it looks like he wants to be here with me or communication issues, blah blah blah. I'm only looking at if he can't get back sooner than later how this will effect ROC. My husband's mom had a stroke, he is a evangelist so he had speaking engagements that also delayed his time til the 29th. But again this wasn't to put all our business out there just 2 get some few answers just in case. He's working hard on returning. We are aware that time is crucial that's why I posted. One thing that I have noticed with some post is when someone ask a question to much other outside comments are given but the very questions seem to get overlooked. That's why I said only comment if you know the answer. So please only those that really know the answers comment.

I remember your story and unfortunately I always thought this man was using your faith to con you. You didn't like my opinion. The truth of the matter is that regardless of my opinion, it will prove extremely difficult for him to ROC. I believe it was advised before he left the country that this did not bode well for his future here. The fact that he didn't get on the airplane to be with his wife that he hasn't seen in 4 months is pretty telling of his character.

In order to successfully ROC you will need to prove co-mingled finances since the beginning of your marriage. In the long run, it may be best for you if he doesn't raise the funds to purchase another ticket.

But you see, people aren't ignoring your questions, the 'comments' you didn't ask for are part and parcel of the problems you will face. His inability to feel comfortable here has delayed him, and the longer he stays away the harder is ROC is going to be, if he's allowed to do it at all. I'm sorry about his mother and her stroke, and about his busy speaking engagements, but you both need to understand the USCIS doesn't care about any of that. He came here to be an LPR, and needs to be here, and he is not. That is all they care about. He needs to return, and on the double.

One thing I've noticed aout people who pose questions on VJ. When they get the answers to their questions, and they don't like what they are reading, there is a tendancy to get all huffy about it. Don't be that person. People are geniunely trying to help yolu.

I have no problem with other side comments, AFTER I get the answers that I am posting about. Now I have them so all good. One other thing I came here because my friends that I have who's husband's have ROC'd couldn't answer so they pointed me back to VJ. Then I come here and get a lot of other comments so I was back to square one which is, who can give me the right answers? I was tired of going back and forth, and again I do understand USCIS position on the purpose for him being here. Thank you all again!

You know I am reading your post and u need to be more serious about it than your husband send me another money for ticket.. so that he does not miss the 5 months 30 days of staying out of the country
