My only thought on this is to file DCF you need to use your current Countries address so I would think if you use a US address it might be turned down for DCF???

Hi,

Just need some advice here abt filing I-130 via DCF. My husband is the US Citizen and he does not meet the income requirement so we definitely require an affidavit of support.

Does he need to file an affidavit of support from himself even though he does not have a job at the moment? My uncle will be the co-sponsor in the adfidavit of support we will be submitting. Thanks!

He still need to complete i-864 since he is the principal sponsor. He'll also be needing an explanation letter as to why he didn't file ITR.

Got it! Thanks for your speedy response ?

But how about for the proof of domicile? He went back in the PH since he needs to finish college here. He just graduated last year. However he doesnt have any bank accts, a drvers license or rental leases or utility bills since he was still underage when he was sent back to the PH. What type of paperwork do we need to present for the proof of domicile? We'll be living with my uncle when we get there, though.

Try to get a letter from your uncle stating that you guys will be living with him and you may also have your husband register to vote (i believe you can download the form and mail it to whatever state he'll be voting - to also show intent that he's moving back to the US)

I would think an explanation of the situation would be helpful.

Also a letter from your uncle as Lhanzo729 suggested,

not many people here seem to agree but the one we passed today was notarized and I believe that helps and many lawyers say it is required..

Good Luck! :)
