A household member is a family member living in the residence where you maintain your home of record in the US.

My mother lives in my US residence.

Thanks for your replies.

This is news to me as I've been told I had to file the I-864A and others here in Manila have submitted one also, but I see your point.

It's not really a problem I can fill it out and use or not use it depending if they ask for it at our interview.

BUT, my real problem is;

When I fill out my I-864 in part 5. “Sponsors Household Size” the household size is 3.

but

On my mothers I-864 the household size is only 2?

Unless I count myself in #7?

#7. OPTIONAL: If you have siblings, parents, or adult children who are combining their income with yours by submitting Form I864A, enter the # here.

Checking or adding a 1 in #7 doesn't seem right but neither does household sizes being different on the two I-864's ??

Your mother is filing as a joint sponsor who can be anyone in the USA who meets the Poverty Guideline. Her household size includes anyone she claims on her income tax and the person she intends to sponsor your wife. Line #7 does not pertain to you since you are not combining incomes and your mother is accepting full financial responsibility.

By what I've been told an I-864 from myself and my mother is all that's necessary, and as I said it makes sense to me.

I admit when you said,

2/1/ 2016 sent AOS & IV packets together to nvc while I waited for iv fee to open to save time.

2/4/2016 paid IV Fee and waited to do ds260

2/3/2016 nvc received aos and iv packets(scan date)

2/7/2016 ds260 completed and now waiting for cc

Handed in aos sept 11th

Set 18th another update

Sept 28th update and embassy called

SEPT 29TH ISSUED FINALLY

OCT 2nd visa in hand

POE October 22nd 2016

APPROVED

I believe so also and as I said it makes sense where-as the other way didn't.

I'm glad I posed the question and I believe as you say, it's the correct way..

this is all going to depend on how you do taxes. Since you are on disability, does your mom claim you on her returns? Do you have to file? if no, you have no returns for 3 years to show

USCIS looks only at the taxable income line and if no taxes are paid on SS income, it will not be considered. Several have ran into this. TI here is a special form to file with SS taxes to get 75% of the income used for the support.

Personally I don't have to file and no I'm not on her returns.

She has filed for the past 40+ years but is now on retirement and I've wondered about this because over half of her income is SS.

Her annual income is over 40k but her taxed income is only about 20k which includes about 2k of her SS.

If we do it including assets then there is no problem, just more work.

Our combined income is over 50k annually which I would think they would at least look at since it's listed several places on the forms and we are doing this DCF but if you know a way to get more of her SS counted it might be very helpful.

Looking at the #'s it looks like about $80 short this last year and over for the 2 previous years.

We are going by 2014 taxes and back so maybe I need to contact her and see what her 2015 looks like if she even knows. She just filed them last week.

He is my scenario and i hope this will clear up , my mother petition my brother, and my mother lives with me, i am the co sponsor, and my mother is the sponsor with no income, she filled I-864 and I filled I-864A that's all we did and our case is complete and approved, and another note my mother is living with me.

I don't think I understand what you are saying. I know they look at line 22 to get the income amount from the tax form, but I I find it hard to believe that showing documented proof of SS would not be counted as income for form i-864. If it could not be counted as income, I would think they would count it as an asset.

A quick check on Google says SS can be counted, but SSI can not.

I'm waiting for "Adil & Jeanne" to reply and explain more about what they said about taxable income and knowing of a form to include 75% of SS.

On the I-864 In part 6, 19 they ask for the adjusted gross income which in our case is 20k less than what is listed in part 6, 15, over 40k.

I know my Mom does pay taxes on 2k of her 22k annual SS income.

The form says they will use the $ figure in part 6, 15 so that is no problem.

But

I have also heard as Adil & Jeanne brought up that they go by the adjusted gross which in our case is short $80.

I can't believe they would turn us down over this and my thinking was/is to wait and see and if necessary we can add assets.

This might make for a good New post..

If your mother lives in your residence, then you can choose to count her as part of your household, and her income can be added to your household income, and she would fill out an I-864A. The combined income from you and your mother would have to be enough for a household size of 3.

Or, your mother can act as a joint sponsor. You would fill out an I-864, not counting your mother in your household size; and your mother would fill out an I-864, not counting you in her household size. Each I-864 would have a household size of 2, and your mother's income alone would need to be enough for a household size of 2.

I think in my case since I have permanent residence in Phils I will file 2 separate I-864's.

If by chance her income is not enough we can easily add assets to cover the difference if in fact there is any.

I think we're good but to be sure I started a new post about what income is used in the I-864.

Yes, I can see how that would work. It could even maybe help if each party is a little short, but would be fine if they file on the same i-864. I haven't sat down to do the math, but its does sound like it could help in some cases.
