Hello,

Background, I'm the US citizen living in Phils over 3 years, married over 2 years to my filipina wife.

So far, I-130 approved, DS-260 submitted.

We live on my income SS disability which will not be enough so my mother has offered to sponsor my wife.

We will also be residing at her home when we arrive in the US.

It was my understanding that I needed to submit a I-864 myself, a I-864 from my mother and a I-864a signed by us both, my mother and I at our interview.

Does this sound correct so far?

Your mother would be co sponser. You both will fill out a i184. I184a is only used if someone lives in the sponsers household and their income is needed.

1/18/2016 paid aos fee

1/28/2016 review 261 to get iv fee unlocked ( unlocked once I did review,was taking to long)

2/1/ 2016 sent AOS & IV packets together to nvc while I waited for iv fee to open to save time.

2/4/2016 paid IV Fee and waited to do ds260

2/3/2016 nvc received aos and iv packets(scan date)

2/7/2016 ds260 completed and now waiting for cc

♧CASE COMPLETE. .. march 8th

3/11/15 interview email

4/20/15 shots 4/25/15 rest of medical exam

INTERVIEW APRIL 27TH @8:30

April 27th 221g for additional documentation and placed in administrative processsing.

June 20th submitted evidence requested

June 23rd case was touched by embassy

August 1st case was touched again.

AUGUST 16TH embassy called and wants a new co sponser yet he met requirements.

Found a new co-sponsor

Handed in aos sept 11th

Set 18th another update

Sept 28th update and embassy called

SEPT 29TH ISSUED FINALLY

OCT 2nd visa in hand

POE October 22nd 2016

Thanks for your replies.

This is news to me as I've been told I had to file the I-864A and others here in Manila have submitted one also, but I see your point.

It's not really a problem I can fill it out and use or not use it depending if they ask for it at our interview.

BUT, my real problem is;

When I fill out my I-864 in part 5. “Sponsors Household Size” the household size is 3.
but
On my mothers I-864 the household size is only 2?

Unless I count myself in #7?

#7. OPTIONAL: If you have siblings, parents, or adult children who are combining their income with yours by submitting Form I864A, enter the # here.

Checking or adding a 1 in #7 doesn't seem right but neither does household sizes being different on the two I-864's ??

why 3, do you have a child?

if not the household size is 2, you and your wife,

if your mother has no dependents, such as spouse or minor children that she declares on her taxes, her household size would also be 2

Because on mine I listed my mother under #7


I guess "household size" is a relative term pertaining only to income, not actual household size? My mother, wife, and self?

hi

nope, you don't list your mom, she isn't your dependent

you are two separate households

she isn't filing the i864A

you file an i864 and she will file another i864. not the i864A

I believe I understand what you're saying.

I just went back and made a considerable amount of changes on both I-864's.

So in the end there is no mention of my Mom as the joint sponsor on my I-864

&

Likewise no mention of me on hers because we are both sponsoring my wife / daughter in law on our own I-864.

I guess you're saying we are "2 separate households" because presently we are and the fact in the future we will be one in not relative at this time.

hi

you will still be 2 households even if you live in the same house. it doesn't matter how many people live in the same house, if they aren't your dependents and you don't declare them on your taxes, they aren't part of your household

Thanks for your help.

It all makes sense now but is far from the direction I was heading from other DCF IR-1 posts here.

I had all my papers filled out WRONG and something told me so which stopped me in my tracks several days ago from sending them to my Mom in the US to be signed. Now I feel much more comfortable and again thank you.

I notice your from my hometown. Miami sure has changed since I was last there.

Everywhere I read about the I-864A I read the same thing.

"If you do not meet the financial qualifications, the income of certain other household members can be added in to your income level if they sign a contract on Form I-864A, Affidavit of Support Contract Between Sponsor and Household Member, agreeing to make their income and/or assets available for the support of the relative applying for permanent residence."

This is on the USCIS site. I also found it several other places, finally one that wasn't PDF (a lawyers site) so I could copy and paste.

The only thing that comes to mind is it different because it's DCF??

I wish I could put this issue to rest for good.

Submitting two I-864's makes perfect sense but why do I keep reading this same thing almost everywhere?

Another thought that might explain it by DCF is the only "household member" I have at this time here in Phils is my wife. My proposed joint sponsor lives on the other side of the world. Depending on how I list my "home"?

You are not a dependent of you mother. She is signing to support your wife. Unless her husband is still alive, there is no need for i-864a . Your mother is not dependent on you. You are only signing for support of your wife. You are looking at it as if the finances are co-mingled. But your tax forms show they are not.

You are correct. Just make sure the mothers income will be enough to cover the entire Poverty Guideline minimum requirement for both her household and the intending immigrant (wife). They cannot combine incomes when filing the I-864 as joint sponsor. If the mothers income is not enough to meet the Poverty Guideline then she should file an I-864a to supplement the sponsor's (her son's) income.

I have enclosed a copy of the latest Poverty Guidelines.

A household member is a family member living in the residence where you maintain your home of record in the US.

My father passed some 10 years or so ago and Mom lives alone.

Money is not an issue at all.

I guess where it gets confusing to me is "household members" and while we are not living with her now we will be once back in the states until we make other arraignments if in fact we do. One of the reasons for moving back is she's getting up there in age and could use some help. She has a large home that will be mine so that's not an issue either.

Filling two I-864's makes perfect sense to me.

When filling out a I-864 it's very easy to get diverted to filling a I-864A by following the process.

I plan to email her I-864 on Sunday so she can print, sign, and mail it back on Monday unless I learn otherwise.
