Getting a state ID while waiting for AOS? K1 visa holder

.My husband is here on a K1 visa and we have already applied for AOS.

We went to the DMV twice this week in downtown Chicago to get his state ID. The first time we were turned away was because they refused to accept his NOA (that we received regarding his AOS) as a form of address. Even though it specifically states that government issued mail does count as a valid form of address. We left the DMV and I called them yesterday morning and talked to someone that works there on the phone and asked if our NOA from the U.S. Department of homeland security counts as a valid form of address and she said yes, it does and she has no idea why they would turn us away.

We went back there today and brought several different forms of address including the NOA, our apartment lease and bank statement and once again, the DMV workers said the NOA is not a form of address and I asked why since its government issues mail and he points to the bottom of the page where it says "DMV workers have the right to deny any documents they chose to". Then he asked me what's my husbands status here, I told him he's K1 visa holder and he proceeds to tell me that K1 visa holders can't get a state ID and he has to wait to get a green card.

Absolutely RIDICULOUS. They refuse to accept valid documents and then tell me he can't get a state ID at all.

I've done my research and I've read that other K1 visa holders were issued an ID, so why I am I being told my husband can't get one? Has anyone else had any issues getting a state ID with a visa? Any advice would be helpful.

In general, the best proof you can get as far as dealing with a DMV goes, is a valid EAD followed up with an SSN (which I assume you applied for as a part of the AOS process?). We certainly did present the AOS envelope as far as proof of address goes, we also presented the envelope for his SSN and a bank statement showing his name/address or a joint utility bill. These might be other options for you. A green card itself won't be a requirement to obtain it.

As a whole, since it is coming from a federal agency as first class mail, there should be no problem for an AOS letter establishing his proof of address, and you could try to seek out a different DMV if possible, but apart from that you'd have to wait for an EAD anyway. You could also demand a supervisor.

On a side note: remember that K1's are temporary kind of visas that have an expiry date. Most dumb ones won't have a clue what a K1 (even at the SSA who need to sometimes be reminded) is and they will see a person who is now married in a 'limbo' status and not understanding the adjustment process... so they're going to want something tangible for your husband status.

you needed two documents bank statement apartment lease,social security some sort of proof that the card is coming k1 visa ....some sort of letter that you are married,

hello...interesting post ,yes K1 can get an state id card and they need one ,for everything ...

it all depends on what dmv you go to .please read your inbox....

Print it out and take it with you, highlight the relevant items you do have (NOA1 from AOS = I-797) from each group.

If they still refuse after you show them the regulations ask for a supervisor.

If the supervisor refuses go to a different DMV, there are many in the Chicago area and file a complaint for those who do not comply

with their own regulations.

The trick is to show the required number of items from each group.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Not sure about IL, but in NY without EAD or GC, the issued ID or DL will only be valid till the date he has on his I-94. That's why I waited for my EAD before I got my ID.

Had the same problem in Chicago just couple weeks before you. Basically, the lady at the front desk said we have to receive GC before getting an ID! This is ridicilous! So my husband is supposed to go on without a car for nobody knows how long? And recently he got his EAD. So he can have a job but not drive? Or just have an ID? 

 

We are planning to go to another location in Chicago with EAD this time and the requirements form from cyberdriveillinois.com with all the documents we have highlighted. If this doesn't work we will have to try suburbs locations.

IL is a known tough state, and the group B documents is where the snag is. You do meet the requirements with either

1. foreign passport + i-94 (both unexpired), if issued under this it will be valid until the i-94 expires, or:

2; EAD - it is on the list that Ebunoluwa provided (i-766)

 

unfortunately IL does NOT accept i-797C (NOA1 receipt) so with the current EAD processing times, there will be a period for K1's that is not covered by any document. (They do accept i-797A which is issued as i-94 replacement for certain extensions, when the i-94 has lapsed.)

Just had this problem in California but a little different. We were told that because the K1 visa expiration date was less than 90 days out, they could not issue and ID. We have the social security card and number, marriage certificate and the postal address verification.. plus an I-94. So now we are trying to figure out if we have to wait for her green card to get an ID or a License. We wanted to get it for ease of domestic travel.
