CEAC - Refused to AP

Timeline

I have an acquaintance who had his interview on March 1 and was refused within 5 minutes. He was not able to answer all the CO's questions and from what I understand did poorly overall at his interview. I'm confused as to what is happening to his case and hoping someone can provide some insight as he is asking my husband for advice and we really have no clue.

CEAC website after his interview stated "Refused". A couple days later, it changed to "Administrative Processing". He did not receive a 221G at this interview and he was given back his passport.

The only thing I can think is that they are preparing his file to be returned to the US; what else could AP mean after a definite refusal?

I think you're right. I think the AP means his file is getting sent back to USCIS.

Nov 2015 - Vacation together in Spain (7th in-person visit with each other)
I-130/IR-1 (second time around)
4 Feb 2016 - Priority Date
19 Apr 2016 - NOA2

17 May 2016 - NVC Case Number Assigned

31 May 2016 - Sent AOS/IV package to NVC

5 Jul 2016 - NVC Case Complete

10 Aug 2016 - Medical Exam

25 Aug 2016 - Interview - APPROVED

1 Sep 2016 - Husband picked up his visa

Timeline

Well I'm guessing it was a number of things including an 18 year age difference and the fact that he couldn't tell the CO what his wife's mother's name is or her previously deceased husband's name. Those are normal things to know if you have a legitimate marriage so I don't know what this guy was thinking.

You are 100% correct, the CO is not the last word and he is not the last word USCIS is so it will be sent there usually takes a year and then you get a reaffirm or you are denied.

Suggest they during this year the wife visit as much as she can and keep collecting evidence and talking to him about all the things he did wrong at the interview. Going over pet's names, family name's her first husbands name with what he passed away from and when. Also sending money is great proof also letters from friends and family from either country. They can't discriminate against age it's against the law so they will use other reasons.

Also both need to write a letter (explaining why he answered the way he did, wife why their marriage is bona fide) because I can guarantee they will get a NOIR and for this you will need evidence and hire a lawyer as soon as they receive the NOIR. I know of a great one lawyer in CA and they do phone interviews so you can be from any state. They charge from $2 to 5 thousand but the main lawyer was a CO and a lawyer for immigration, I researched him and his firm and had a free interview here in Ca with him at a gathering Napolitano had. I will use them when the time comes.

I would also recommend to get the Senator or the House of Representative for your Petitioner's State involved in the case, that will make it more serious and go faster.

Yes good advice usually works at least getting them to help. I love in California and getting them to do anything was a bigger struggle than getting information from immigration, pick the Dept ;) . But that was just me I heard others stating that it helped.
