Questions about A P 221g, Case sent back? (merged threads)

I want to begin by saying I'm very sorry that you have been sent back. Please do not let this discourage you. It's clear that you love this person very much and now the test comes. My husband and I did not file for K1 - though I wanted to so bad. The reality was I knew the odds for approval were against us. I made trips there and in 2013 we married. I didn't file until 2015 because I'm a bit paranoid and hard headed I guess and wanted to make sure my income could be the sole sponsor. At this time we are waiting for the interview to be scheduled and the truth is even though everything looks great.-No problems so far- I still know that things could go wrong and very fast. I take nothing for granted. At this time we are in the IR1 category. Thank God for my husband's patience at this point is all I can say. Who knows what the interview will be like I can't even guess. What I'm trying to say is I guess if I can be any help I'm here and never give up :) giving up is not even in the southern woman's vocabulary :)

I want to know if it is possible to get approved after applying for new k1 visa. Because the first one was sent back under 221g and it was sent back only after 4 days from the interview. Now it's been week since the interview. The CO kept my passport only to call me two days later to come to the consulate. I sent a letter to the embassy accusing her of being bias and discriminating against us after the interview by one day. So this is the whole story. Knowing that she didn't tell me what are the reasons for this further review.

FIrst of all sending a letter to the embassy with accusations is not a good idea. 1. you don't know if they are true. 2. if you want a visa you have to deal with that embassy again, bet they'll remember you now.

Morocco is a tough embassy. Have you done any researching or reading about other Morocco experiences? You need to find out why you were denied before applying again. There is a reason(s). You have to get to the bottom of why your fiance was denied. Go over the interview with him detail by detail. What questions were asked, what comments were made, has he been completely honest about everything in his life?, etc, etc. What red flags does your relationship have (if any)?. This anger will not do you any good unless you use it for a solution. Start investigating. Maybe a senator could help get an answer of reason for denial. You must overcome this issue if you want another chance with a successful ending!

I would do cr1, you will have the same issues doing this over again. It's gonna die at uscis , they basically don't believe your relationship is legit. I'm not saying it's not.... please don't take that wrong. It will expire eventually and making accusations on them won't help any.

1/15/2016 Called NVC and got case/invoice number logged into this site to pay fees, pick agent -> https://ceac.state.gov/IV/Login.aspx 1/15/2016 picked agent DS-261

1/18/2016 paid aos fee

1/28/2016 review 261 to get iv fee unlocked ( unlocked once I did review,was taking to long)

2/1/ 2016 sent AOS & IV packets together to nvc while I waited for iv fee to open to save time.

2/4/2016 paid IV Fee and waited to do ds260

2/3/2016 nvc received aos and iv packets(scan date)

2/7/2016 ds260 completed and now waiting for cc

♧CASE COMPLETE. .. march 8th

3/11/15 interview email

4/20/15 shots 4/25/15 rest of medical exam

INTERVIEW APRIL 27TH @8:30

April 27th 221g for additional documentation and placed in administrative processsing.

June 20th submitted evidence requested

June 23rd case was touched by embassy

August 1st case was touched again.

AUGUST 16TH embassy called and wants a new co sponser yet he met requirements.

Found a new co-sponsor

Handed in aos sept 11th

Set 18th another update

Sept 28th update and embassy called

SEPT 29TH ISSUED FINALLY

OCT 2nd visa in hand

POE October 22nd 2016

First of all do not throw around accusations about the CO because you have to face them again ! That's very counter productive.

Leave your emotions out of this and use the energy to figure out why you were refused. What was marked or written on the 221g ?

A returned K1 will not be reviewed by USCIS, it will be purposely expired, even though they say they send it for review, it will not be reviewed.

It will die and after about 6 months the petitioner will receive a letter saying she can file again.

If you marry and file a CR1 and if also returned, it will not expire and you have a second chance for a rebuttal of the CO's findings.

Yes, a second K1 can be approved, our 2. was approved. Petitioner needs to front load the petition and you need to spend more time together.

Have your fiance register here and do some research on how to put a quality petition package together.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Yes but they didn't say anything about addiction docs that heeded l,I believe they might send it back to the uscis.wish not,anyway thank you for your answer

The US Consulate in Casablanca will not tell you what is needed or additional paperwork. They send the petition back to the USCIS and they will contact you for what is needed. Period. Contact the National Visa Center - to check if there is a note on your file that they will send the Petition back, which mine did. Our petition was not sent back until I had my Congressman get involved. Once the Congressman contacted the US Consulate as to where the petition is, they finally sent the petition back to USCIS. It took 11 months for USCIS to finally receive the petition back. The US Consulate will not communicate with the petitioner. I tried with numerous phone calls, and emails. They respond but will not give you any answers.
