Hi guys! I've been lurking on VJ for a very long time, but now that my fiance and I are officially engaged, now we can start making this K1 journey for ourselves!

I have a question regarding the income tax information required for the I-184 form, I know it's a long way off yet for us but I am preparing for it now. I am the petitioner for my fiance, but I am a graduate student who has been unemployed for the last two years. I filed a tax return for 2013 so I can provide that no problem, but did not file for 2014 as I had no income. I also had no income in 2015- would it be worth it to file for 2015 and back file for 2014 for the sake of making the I-184 form more straightforward to fill out? If I did simply file with 0 income for both years, would I have to go through the fuss of having to write a letter explaining why I wasn't required to file, but did so anyway? Before anyone asks, my father is planning on co-sponsoring my fiance and he easily makes enough money to pass the poverty line threshold, so my income shouldn't be an issue anyway. :)

I've seen people posting on this site getting RFE's when they did not file their tax documents and did not fill out the I-184 form correctly, so I'd like to solve this now so I won't have to worry about it in the future.

Yes, you must follow the form instructions and write a 2 or 3 line note explaining why you were not required to file. And you have to sign it.

Hi there, thanks for your response! Would I need to write a note explaining why I did not need to file, even if I do file, because I was still below the income threshold required to file? If so, should I just save my time and money by not bothering with filing all together and simply write the note? These are my main questions. :) Thanks again!

First I want to say, in case you don't know, that your first Affidavit of Support is the I-134 taken to the K1 interview in London. They will accept one only from your father and nothing from you. London doesn't even require a tax return if the income can be proven with an employer letter for example. (It's a London thing and not necessarily true for other consulates.)

You will do your own I-1864 after marriage for the adjustment of status. Don't file a tax return. Write this:

Statement of not filing a tax return

I was a full time student in tax years 2014 and 2015. I earned $0.00 income so was not required by the IRS to file a tax return.

Name

Signature/Date

If you had any little job or interest earned, then be specific "in 2014 I earned $123.99 and was not required to file..."

Put your statement following the I-864 form where the tax return would be. It is not to be explained in a cover letter for example.

The people who get RFEs tend to be the ones who do not read the instructions for the form carefully. There's little details that you may not find in a forum post a paragraph long. The instructions are 16 pages of info. Read them.
