So will our spouses have to ROC and pay another fee? I am talking about the CR-1.

AOS is Affidavit of Support fee, it is not Adjustment of Status. The current fee is $120. There is also another IV fee for the DS-260, that fee is $325. We will pay that fee when the bill is generated. This is for a CR-1 visa

I called the NVC and found out the interview date, but they also emailed me. NVC normally is the one that schedules the interview with the embassy and then, once the interview date is closer, they will send your information over. I didn't receive anything in the regular mail from NVC, ever.

@gryphon

thanks for your help

so techinally how long is the NVC process

after getting approval from USCIS how many days more at NVC approx the

Most of it depends on how quickly you respond to things, as opposed to USCIS where you just ... wait for them.

So you've got the following steps, all listed here: https://travel.state.gov/content/visas/en/immigrate/immigrant-process/petition/file.html (assuming NOA2 from USCIS):

  • USCIS sends to NVC (up to 30 days)
  • NVC assigns case # (up to 14 days)
  • You fill out DS-261
  • NVC Processes DS-261 (site says up to 15 days to process, just call and review over the phone and should resolve in 1 day)
  • Pay fees (up to 5 days to clear)
  • You submit documents (AOS, IV and DS-260)
  • Once they receive documents, 30-45 days to process and declare Case Complete or they will send a checklist if they need more information. Then this just repeats until Case Complete.

You can shave a few days' time off by calling and checking to see if NVC has assigned you a case # yet and when you submit the DS-261 so you can pay the fees.

I know ROC and AOS are different but isn't that an extra charge for those of us doing CR-1?

By the way, so the total bill to be paid at NVC stage is $445 as of the most recent fee change?

Yes, ROC is $505 + possible $85 biometric (https://www.uscis.gov/i-751 click "Filing fee")

Although, i-485 (Adjustment of Status) is $985 + $85 biometric, so it ends up being pretty close (https://www.uscis.gov/i-485)

(I think most of us would've done the AoS route regardless of that cost difference if we could've =P)

maybe I'm a little confused..Our AOS fee is been paid before the interview so why would that be the preferred route?

In my understanding, the next thing to do after our partners get here with be ROC.

Correct me, if i'm wrong.

In my earlier comment, I thought we will have to pay AOS, IV bill then when they get here, we will pay another AOS $985 + $85 before ROC.

Does anyone know which month are they processing in PSC?

My fault for using the acronym at the end there instead of the full name.

I-130 Fee + Affidavit of Support Fee + IV Fee + possible ROC Fee (later) = How to file when the intending immigrant is outside US

I-130 Fee + I-485 (Adjusment of Status) + ? Fee = How to file when the intending immigrant is inside US

I don't know what additional fees are charged when filing from inside the US. But we've all paid the Affidavit of Support fee to the NVC, not the Adjustment of Status.

If you're doing consular processing (immigrating from outside the US), you do NOT have to file Adjustment of Status.

My comment was in regards to the Adjustment of Status being more expensive, but your spouse is inside the US with you.
