Hi all advise please on old police cautions and getting green card

Hi everyone so my story is I came over on a esta visa 2 years ago previous to this was talking to my wife from the U.K. For a year I never planned on getting married I was coming over to spend time and get to no her.. In this time she asked me to marry her was surprised but I knew I loved her so I said yes we didn't no about me having to stay I filled Aos out thru rapid visa and my plans was to return home when my ticket was up.. And we thought at the time the paper work was so I could come back to stay with her once it was sorted.. A lawyer told us back then that I shouldn't leave because it would make it harder for me to get back or could take many years so we took there advise and I stayed.. So anyways the paper work was sent and I didn't hear nothing for about 9 months so I gets in touch and they said they never received it.. So again did it again then few months back they sent it back for more information has my wife lost her job and didn't call to tell so they needed another 3 months of new pay slips and taxes so cause she just started new job we waited till she worked 3 months.. Then sent it all back now again on hold cause I have to take a medical.. Not so worried about this.. But I've read so much over the last week about these meetings you have to have once medical is done..?? So that's my story on how I came here.. My concern is I have a old caution for petty theft crime.. Story to this was 8 years ago my friend worked in a store.. And was given me discount for a good few months at the time I believed it was his staff discount so never see the problem.. I use to live with this friend.. A few times he came home and asked me to take things back to the store that he brought home and for me to get refund on his items and give him the cash again i thought I was just going him a favor cause he was working to much he never once told me he actually stole the things.. So months had gone by... Next thing I knew he got arrested for this then came home and told me why.. He said I needed to go in for questioning turns out I was not the only person involved.. There was 5 so next day I go to the police station they questioned me and I think they thought I knew I never got arrested I was just questioned and they let me leave the station with a caution.. I never heard from them again after this.. So I'm unsure if this will still be on my record and now I'm really worried to go to my meeting for it to come up.. Does anyone have any similar issues?? And how did it go for you at your meeting?? I've just ordered a police background to see if anything comes back and has prof if I need it at this meeting.. I'm just trying to prepare my self.. Could this go against me and I get sent home? Thank you for reading.. I no after that happened clearly I was silly and should of realized what I was doing at the time or should of questioned my friend at the time I just never thought anything of it clearly till he was arrested.. Any advise would be grateful.

This. Caution includes admitting to being guilty, I believe. That could be problematic. US law does not care if it "went away" according to UK law, only that it did happen. You need records about this incident. Click on that other thread Merrytooth linked, some people from the UK explain exactly what those records are called. Get them somehow & take them to your interview.

Yes I've applied for my records already.. And just seeing if anyone else has had same issue and how it went for them

Thanks merrytooth he has a similar story would be interesting to see how he gets along too I've messaged him.. Scary time ahead once my records come I can see then if I was arrested for this I just remember me going in and walking out and was out within a hour never heard back from them so hopefully there be nothing to show on my records but just in case I'm just looking for some advise and if anyone else has been thru similar situation as my self.. Did you get a caution? If so, that means you admitted guilt.

If you did get a caution it's irrelevant if your records come back clean, you still have to tell USCIS about this incident.

If you received a caution you have to provide a police certificate and a Subject Access Report that detailed the charge. (You actually have a record on file still that would have been revealed on the SAR, but not the police certificate.). If the crime was petty, then you can be allowed to live in the US, but immigration wants to know about everything and make that decision.

In short: it DOES NOT matter if your "record is clear" because this incident "went away" under UK law. USCIS still wants to know.
