Hi there,

I'm looking for some information on getting married to tourist visa holder. I've a girlfriend who I wish to marry within next 2 months, she has recently arrived in states and I read on lots of forums that it's not good to get married within 90 days of arrival. I'm planning to get married after 3 months.

My questions,

Would she be approved AOS me being a PR holder not citizen?

What all documentation is required?

How long does is take?

What all forms I would need to fill?

Any information would be very help and will be highly appreciated.

There's no 90 day rule despite what you've heard or read. She cannot stay and adjust since you're a lpr given the information you've provided. Her visa will have expired before the case was completed. She would fall under the F2A preference in getting a green card. Only spouses of U.S. citizens are forgiven overstays.

Get married, she returns and file I-130. F2A takes 2 years for visa number to be available.

It's not true that you cannot adjust status if you get married to an LPR. You can ... when the F2A category is current (has no wait). However, the F2A category wait right now is too long for that to be possible.

Given the information it is true they cannot. I know that LPRs are able to have spouses adjust given the right set of circumstances. Theirs are not, her visa would expire far before the 130 is completed.

But nothing about priority dates?
