Hi Everyone

I'm having some trouble deciphering exactly which evidence is required with my I-751 form, which I am filing jointly with my US citizen husband to remove the conditions on my Green Card (which I obtained via the I-130 route two years ago).

I would presume that because USCIS accepted the legitimacy of my marriage back in 2014 when they granted me my 2-year Green Card, surely now they just need evidence that pertains to the two years that have lapsed since then?

A lot of immigration sites online are saying to include information that goes right back to when we met, and our wedding, including a marriage certificate and wedding photos. Does anyone know if that is needed? They also say to include scans of both our passports - is that necessary?

Here's what I was planning to including with the petition. Could anyone please advise if they think this is sufficient?

Documents for spouse (me):

  • Scan of Green Card

Joint information:

Proof of living together:

  • Copies of two apartment leases since 2014, showing both our names

  • Scans of our drivers licenses showing the same address

  • Postal office registration to redirect mail to our new apartment (we are in the process of moving as we prepare this)

Proof of joint financials:

  • Joint US tax returns
  • Joint credit card statements

  • Photo of our Visa cards showing a joint account

  • Joint car loan statement

Proof of co-mingling:

  • Life insurance policies showing the designation of insurance to each other

  • Joint car insurance policy

Other:

  • Three affidavits by U.S. citizen friends and family members, attesting to our relationship

  • Copies of airline reservations for vacations together - SINCE GREEN CARD WAS ACCEPTED ONLY

  • Statement from our local vet, showing joint ownership of our pet dog

  • Screenshots from our Facebook friendship status - SINCE GREEN CARD WAS ACCEPTED ONLY

  • Photos of with family and friends - SINCE GREEN CARD WAS ACCEPTED ONLY

  • Gift certificate from me to my husband as a birthday present

  • Cards from both our mothers, address to both of us, plus a birthday card from me to my husband

On a final note, does anyone know if the fees we should provide for filing plus biometrics can be combined into one check, or should we provide two checks for each?

Thank you in advance!!

They want evidence from the date of your marriage until the present. Your list looks good to me, but we're still waiting for ours to be approved so take my opinion for what is worth. :)

As for the fee, you can combine together. Just make sure the amount is exact for both the filing fee and biometrics and you make it payable exactly as stated in the instructions.

Good luck!

I disagree about what your suggestion to send the evidence from the date of your marriage. They want to see the evidence from the date that you obtained your conditional green card (2 years) because the IO already have your evidence before your 1st interview when you were seek your conditional green card. They don't want you to see duplicate evidence that the Immigration already have. They want to see a new evidence that you didn't provide before. So send just the new evidence for the two years from the date your conditional green card is granted. (That’s my lawyer answer to me when I asked him about the evidence that I should send to IO for ROC)

Good luck

I will say no to that. We have successfully completed ROC and did not include meeting, wedding, or marriage certificate. So it is entirely possible to do without that. Some of our evidence was dated pre greencard, like our first joint bank account and first tax return together because USCIS had never seen it. The rest was in the general timeframe following the greencard.

You have good evidence. Go with it. Maybe leave off the Facebook and gift card. To me that is kinda silly and weak clutter when you have other hard evidence like tax returns, leases, insurance, and credit cards.

Not to get sidetracked, but the suggestion of going back to the date of the marriage is not mine. The form instructions explicitly state that evidence be provided "...from the date of the marriage to the present date..."

Fortunately, there is not just one correct way to get a ROC petition approved. In the end we all have to decide how much to send and how far back to go.

Here's hoping we are all successful sooner rather than later.

You are right if and only if you did not provide this evidence to IO when you had your interview for Conditional green card. They don't want to see duplicate evidence again in ROC. They are looking to see a new evidence that you collected. The immigration have a file for each one since you came here, in this file all what you send is go there.

Thank you

Thank you, everyone! My husband and I were married for a whole year before I moved to be with him and we filed the I-130, so the USCIS have the information from marriage until filing. I will supply information that pertains to the time since we filed.

I appreciate everyone's help!
