Now first, 'Hi' everyone. Hopefully it'll be a fast and smooth ride for all of us.

I sent my application out on 4/1, delivered 4/4 in Lewisville, TX. My CC got charged 4/12. My field office will be Fairfax County, VA. I have my GC since 3/2006. I have not received my NoA as of yet.

Now, after introducing myself, I have a question for you all. I filed upon marriage, even though I know I could have done the 5 year app too. I send lots of supporting paperwork with the application, but I did not send tax returns or transcripts as supporting documents because the instructions stated 'OR' not 'and'.

Am I assuming correctly, that they still accepted the application nevertheless because my CC got charged? And how high is the risk of delay now because they'll request the transcripts as additional evidence? I mean, as far as I can read, it is recommended, but not required.

(...and no, I am not a tax cheat. Always paid my dues and filed our joint returns on time)

What did you send?

The document checklist is pretty clear for point 4.

Yes it is a "or" but you have to comply with either a, b or c

Documents referring to you and your spouse:

a. Tax returns, bank accounts, leases, mortgages, or birth certificates of children; or

b. Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past 3 years;or

c. An IRS tax return transcript for the last 3 years.

Thanks for your quick response JGD108. I re-read those requirements like dozens of times. Even under 'a' it lists and then says 'or'. So, I'm no lawyer, but I have to work with legal language on a daily basis and it did not look like a requirement to me, but more as a listing of possibilities.

Hope it goes through for you. All 3 bullets really emphasize on tax returns. You should have 3 of them (2012-2013-2014 tax years) since you have been married to USC spouse those 3 years

Great, if you have 10 years of returns I would not wait for RFE. Call USCIS when you have your NOA and ask how to send additional information with your application.

RFE usually add an extra month of delay which is not ideal on an already 5-6 months process !

Had my approval in a few days of them receiving my packet. My takeaway there was the return transcripts are super important, more so than the other docs. So this time, for N-400, I got the transcripts first and will just be brining the other OR options during the interview. Absolutely not sure if that will work. Just sharing. But since it is an OR list, let's hope they don't send you an RFE and just let things go smoothly =D

They actually don't use word "OR" in I-751 instructions, exact wording is "Submit copies of as many documents as you can to establish this fact ...... The documents should include, but are not limited to, the following examples".

Really unsure now. I thought they were emphasising alot on it too, but still did not send them. We have all returns since '06 still in our files.

Should I wait for a RFE now or can I send additional information in earlier? And if so, how? I'd figure, I need my case# first and foremost. So, probably awaiting the NoA and then call them. As they charged my CC, I am fairly certain that a NoA should arrive soon.

I'm chiming in to hopefully put your mind at ease. I'm not sure at what stage they send out RFEs, but I did not send tax returns or transcripts and I just received my in-line notification. Hopefully that means we're good but I'm not entirely sure. For what it's worth, I agree that the "or" wording makes all the difference. Nowhere does it say that tax transcripts are a requirement. I was planning to visit my relatives in my country after getting my citizenship. However, I checked the processing dates in the USCIS webpage today, and as I understand my citizenship won't happen until September-October. Is it ok for me to take my trip now? Would that affect my citizenship process? it is going to be a 4 weeks trip.

Please help!!!

If you've already done your fingerprints you should be fine(that's if you're looking to travel this coming week). It take at least a month and a half to go from biometrics to Interview.
