Is this too much evidence? Did we need more?

My USC wife and I have filed for AOS. I originally came on an F-1 visa and we have been together for more than 4 years. We have been married for 1.5 years. So naturally we have lots of evidence. When we filed we sent these evidences

1. Joint Bank Account- 12 months(although we had more than that, our finances were co mingled before we married)

2. Joint lease for the last 4 years(for 3 different residences)

3. Joint Credit Card Statements(12 months)

4. Joint Car Title

5. Joint Car Insurance(Copies for the past 12 months)

6. Joint Rental insurance

7. Joint Internet Bill(Past 6 months)

8. Joint Electric Bill(Past 6 months)

9. Married filed jointly IRS Tax return Transcript(2015)

10. About 50 pics together, along with some with her kids included(we have no kids together and I never had any kids prior)

11. Copies of flights taken together

12. Cards addressed to both of us(mostly from her daughter)

13. Mail addressed to both of us

14. Drivers Licenses showing the same address

15. Her Life insurance with me as beneficiary

16. Pictures of Alaskan cruise taken together

I have been reading a lot of posts concerning evidence of bona fide marriage on VJ lately and some people have said that more evidence such as health insurance with each other as beneficiary and wills with declaring each other beneficiary is required. Others have said that this could be way too much.

Did we make a mistake or will we get an RFE for this? We just wanted to give everything we had so that the adjudicator knows that we are bonafide. Would you have thought of something else to attach along with it? We still have all the originals and we only sent the copies.

Your evidence looks fine to me. On a side note, you could have filed 3 or 4 months later to ensure you'll be approved after your 2nd anniversary. That way you would have gotten a 10-year GC and could have skipped the whole ROC process 2 years down the lane.

This way though you'll get a 2-year GC first and will have to send similar evidence again at ROC after which you'll get a 10-year GC.

No single piece of evidence is needed nor will it break your case. It seems like you have a lot of evidence for the AOS (actually much more than I've seen with other people's) so you should be fine. USCIS will not demand that you show them you have joint health insurance.

And as stated above, I too would have waited the extra months to file for the 10yr GC and avoided the extra $590 in fees. Good luck!

Thanks guys! Its still in process. Our 2 year anniversary is in September so if we get approved after that, we would get the 10 Year GC right?

Yes, but in-country AOS takes about 4 months and you already filed so it's unlikely your case will stretch all the way to September.

If you do get an RFE (unlikely based on your evidence, maybe for something else like I-864) then you can wait towards the end of the time period they give you in which you must answer to stretch out the processing time. But it's unlikely you'll get an RFE.

My wife made over poverty limit ($23k, I only earned around $2.5k through on campus authorized part time job). She transferred through jobs(got new one last year). We attached her W-2's from both jobs, included the joint tax return transcript. Do you think we needed more evidence for I-864?

No, that's fine. I was actually saying that getting an RFE would be useful in this situation to help stretch put processing times. But like I said it's unlikely.

I don't believe I sent one, but it was almost 5 years ago.

Many cases on VJ taking longer than 4 months. Our AOS took 16 months. Seems to be related to how busy the local USCIS office is.

That's AOS from K-1 timeline. AOS from any other visa is usually much quicker. Believe me when I say my local office (Dallas, TX) is VERY busy (as evidenced from my N-400 timeline in my signature), AOS still took less than 4 months.

Good to know...I thought AOS was AOS and everyone got in the same line. I didn't know it depended on what visa you were adjusting from. I learned something today!

I actually think you're mistaken. AOS from K1 visa is one of the fastest from what I've read on this forum in the past a few years... but in all honesty it really does depend on your local office, unfortunately...

It seemed to me some K1ers wait 8-10 months or more for their GC. It took me less than 4 months (non-K-1) and my local office is VERY busy (naturalization took me 8 months).

I looked in the AOS from family visas progress reports forum, some July 2015 filers still don't have their GCs. Granted some people get theirs in 3 months or so. I'm still skeptical though that it's solely based on how busy the local office is. It all goes to NBC first, I believe?
