This is a complicated one, I hope someone out there can give me some advice as to how to proceed.


Firstly, a little back story. I should note at this point that I am a UK citizen.


October 2011 - I married my girlfriend of two years (a US citizen) in the State of Florida on the VWP. I returned home to the UK a week later.

April 2012 - We start preparing for the marriage visa process (IR-1/CR-1 visa), although the relationship begins to get a little rocky so we never actually ended up starting the process.

December 2012 - After a rough 6 months, including my wife being unfaithful to me, we separated.


The last time I saw her in person was around Fall of 2012, we split up shortly after I got home once I found out that she had been unfaithful. After separating, we continued to talk to each other online once in a while throughout 2013 and early 2014. I have not spoken to her at all though since late 2014, I have no idea where she is living now, nor do I have her contact details anymore.


I am wanting to get divorced this year so that I can finally move on, but I don't even know where to start. We've never officially lived together, we didn't have a shared bank account, and like I said.. we've not even spoken since 2014. I have no idea how the proceedings go, and I'm worried about how much it's all going to cost.


To complicate matters further, I've been dating another US citizen for the past 16 months, and we've discussed the possibility of marriage someday in the future. (not this year, of course)


This is probably the wrong place to ask, but hopefully someone can shed some light on the following questions I'm about to ask:

  1. How exactly do I even begin the divorce process, given the information I've provided?
  2. Roughly how much might it cost me? Would I have to pay anything at all to my wife, despite not living together or anything?
  3. Will this divorce impact our success chance of obtaining a K1 visa with my current partner in the distant future? (post-divorce of course)

So you live in UK and need to divorce a US citizen? Then you need to check how to file for divorce in UK. Than proceed from there. How much will it cost have no idea how much it cost.

  1. How exactly do I even begin the divorce process, given the information I've provided? read up on how to file in UK
  2. Roughly how much might it cost me? You are in another country have no idea how much, Like here in US each state has their own fee's
  3. Would I have to pay anything at all to my wife, despite not living together or anything? I doubt there would be any alimony like you said you never lived together.
  4. Will this divorce impact our success chance of obtaining a K1 visa with my current partner in the distant future? (post-divorce of course). There may be scrutiny for you at interview but you never filed. So really not an issue.

Maybe have a consultation with a lawyer. The biggest obstacle is filing and serving her. Or researching how to file when you don;t know where someone is.

You best option might be for her to file for the divorce. If they have no fault divorce in her state, you can come to an agreement, both sign the papers, she turns them in. I know in my own state, there would not even be a hearing in such a situation, the divorce would be granted in less than a month.

You don't even need a lawyer, as many states provide do it yourself templates. The only cost would be the court fees. Which runs about $400 buck in my state. But my county makes you pay to get the divorce decree, another $5 per copy.

with a USC take it slow

The OP has no contact with her and don't even know where she lives. Why waste his life waiting for her to maybe divorce him? He should just divorce and move on.

4/28/15 - Called and NVC said supervisor had reviewed and now claimed that the decree absolute was not included. After disagreeing with the less than helpful lady on the phone, and her not being able to get the review time right. (She kept changing her story between 42 days and 30 days).

4/30/15 - Sent the same copy of the decree absolute to the NVC from the UK, highlighting the "decree absolute" wording with a letter stating that this is the only document provided by the UK government.

5/6/15 - Scan date for checklist received.

6/5/15 - Case complete!!!

6/12/15 - Called and interview is scheduled for July 1!

6/14/15 - Received email with interview date and instructions.

6/19/15 - Case showing as ready on CEAC.

7/1/15 - Approved at interview!!!

7/6/15 - CEAC changed to Administrative Processing

7/7/15 - CEAC changed to Issued!!!!!

7/10/15 - Passport and packet delivered!

7/29/15 - Husband entered with visa at Dallas/Fort Worth airport

9/29/15 - GC delivered!!!

5/4/17 - ROC packet sent via USPS

5/9/17 - Tracking shows delivered

5/17/17 - Check cashed

5/19/17 - NOA1 received with date of 5/8/17

5/27/17 - Biometrics appt received 6/8/17
