Yes... They requested $420.00 I invested so much money plus $ 623.00 for I 485 and medical exam $85.00 is too much and now if i do an appeal it would be another $630.00 I truly feel that it was an administrative Error by the uscis

420 is the fee for an I-130. is it possible that the adjudicator not understand this human was adjusting from a K-2 ? something's massively wrong, not fixable with a phone call to any csr.

I know but they did require an I-130 plus $420 fee to be submitted with the RFE

OK - something is massively wrong. i posit the adjudicator not understand this was an AOS for a K-2. I suggest you engage with a human at your congressman's office - usually they are called 'constituent liason' for title, and you need to find the right one there that fills the role of 'immigration liason staffer' there.

1. pick a congressman (there are 3, 2 senators and 1 member of the house of representatives)

2. CALL , use a telephone, find the ILS human. get the name, phone number, extension, email address, fax number.

3. send out a signed privacy release notice, scan it in with a signature, send it off in an email using the email address captured in step #2.

4. wait 1 to 2 days. whilst waiting, write up an explanation of what you think happened, covering the fact that the adjudicator erroneously issued an rfe for an I-130 for a k-2 that was adjusting, asking for a refund of that $420 for that I-130 fee as well.

5. email your write up to that human after step 4, in the morning. call back in the afternoon, asking the ILS human if they had a chance to review your email. View this phone contact as actual first contact with the ILS human, you'll need to have a longish conversation during this phone call.

Exactly. A K-2 does not require an I-130 for AOS. I am not sure what happened, or why that was asked for. For some reason the adjudicator did not know the case was for a K-2 adjustment. While following the above advice about contacting a congressperson, make an infopass appointment and speak to an IO about why the K-2 was asked for an I-130 and fee for that form that is not needed.
