Hi guys,

I got my case number on 03/14/16 after calling NVC. I filled out the Ds-261. (Choice of address and agent form) the same day.

I have a question about filing my 2015 taxes return. I did not work last year but still plan on filing my taxes. I was a full time student living off loans and I had stock investments. The question is how do I file, is it married filing separately and what is the steps for that? Or is it even a requirement to file that way? Also I recently started working as of 6 weeks ago but when I was filing out the job paperwork I put that I was single but now I plan on submitting my w-2 with my I-864 and it has single as my relationship status, would that be a problem? If someone, anyone can please help answer these questions for me I will really appreciate it. Thank you.

My welcome letter was emailed to me today without calling NVC. Now can you guys tell me the next steps in this process while I wait for my husband's passport, police clearance certificate and the second sponsors I864 with the financial documents, etc.

If you are filing taxes for the year in which you were already married, then you HAVE to file as married filing joint or married filing separately. To file jointly, both spouses must have a SSN or Individual Tax Identification Number (ITIN). Otherwise, you can do married filing separately and put down 'NRA' for the SSN of the spouse who doesn't have a SSN.

If you only started working 6 weeks ago, I'm not sure how you would have a W-2. I thought the W-2's were mailed/sent for the previous tax year, so you should only be getting your W-2 for 2016 in 2017, in time for you to file your tax return for 2016. Perhaps you are confusing the W-2 with the W-4 (Employee's Withholding Allowance Certificate), which is part of your pre-employment paperwork, where you make the choice of single, married, etc. From the instructions on that form W-4, it appears it is okay to choose single if your spouse is a non-resident alien. But I do not know if it is helpful to submit the W-4 with the I-864, as it does not show any information about your income.

The pay stubs shows your status as single because that is the status you chose on your W-4 before you started working. You cannot change the paystubs afterwards. Taxes are deducted from your pay based on the exemptions you claim and if you paid more or less than you should have, you will either get a refund or have to pay more when you file your tax returns. If you want to, you can explain in a cover letter sent along with your AOS package that the pay stubs show you as single because according to the W-4 instructions, you chose your status as single as your spouse is a non resident alien.

You should really ask your tax preparer what, if any, documentation they need for you to file as married filing separately. I really don't think you should need any but it couldn't hurt to take your marriage certificate along with you.

New to visajourney. This is actually my third round for this process. First husband was a K3. Second one was an Adjustment of Status. Third one I find myself dealing with NVC. Hubby is a masters student in Canada but is actually from Iran. After the second one I swore I'd never do this again, but 7 years later, here I am again. I'm actually kind of surprised they approved the petition for this one without an enormous amount of paperwork or an RFE, but we sent the required paperwork, plus affidavits and pictures, plane tickets, etc. Couldn't send chat transcripts because it would have been 113,000 pages long.

NVC scan date is March 7, 2016. Because of my child support court documents I needed for the AOS, I ended up having to mail in the packet instead of using EP (embassy we're dealing with is Montreal). I called and talked to three different people at NVC. First one wasn't terribly helpful and seemed a bit new and said I'd just have to send multiple emails and split up the documents if the document size was going to be too large (which it was, by a long shot, couldn't compress it without making it unreadable). This didn't sit well with me, so I called again and was told mailing it would be a better option, especially as it seemed mailing was going a bit faster these days. Called again a couple hours later just to make absolutely certain and the infamous Joanie that everyone here says is a bit surly confirmed that yes, I should mail it in and that mailing was going a bit faster than EP. From my readings of the various forums, it seems things go in cycles where one goes faster than the other depending on how people are sending their docs in.

Hoping I "dummy-proofed" the packet well enough that we don't end up with a checklist. I made sure everything was put in order according to the checklist, with post-it tabs indicating what each document was, wrote a letter telling them exactly what page and what line they could find the child support portion of the decree, and flagged it with an arrow post-it. Since hubby is from Iran, he doesn't have a birth certificate, just their "registry" document, so I double checked the department of state requirements, took a screen shot of the part saying his registry document is acceptable. Did the same for the police certificates from Iran and the UAE (they aren't required for various reasons). Just hope that takes the "thinking" out of the processing part. Never done this part before so it's very different for me and have knots in my tummy.

Praying we don't end up with the dreaded checklist because traveling back and forth is not fun and we're supposed to close on some property soon, would be nice to have him here.

Your filing status actually depends on whether or not your spouse is a resident or not. If your spouse is not a resident, you are not required to file taxes with your spouse, but you may choose to do so.
